LEGISLATIVE ACTION

The Legislature accepts the Executive recommendation and augments the Executive proposal by providing for additional appropriations of $6,000,000 for civil or criminal legal services and district attorney tuition reimbursement and $2,800,000 for local criminal justice initiatives (Westchester County Policing $2,600,000; Road to Recovery Program $200,000).

Article VII

The Legislature concurs with the Executive proposal to increase various fees and surcharges to provide General Fund relief, provide additional support to the Court Facilities Incentive Aid Fund and funding for a new Indigent Legal Services Fund. The Indigent Legal Services Fund will provide financial assistance to the State and to localities to support increases in the hourly rates of court-appointed counsel.

With this legislation, the Legislature provides for a Legal Services Assistance Fund which will be used to support services, expenses or reimbursement of expenses incurred by local governmental agencies and/or not-for-profit providers or their employees who provide civil or criminal legal services.

The Legislature adopts Article VII language that directs the Commissioner of the Division of Criminal Justice Services to make payments to the County of Westchester for costs associated with the policing of certain parkways.

The Legislature accepts Executive Article VII legislation that would increase fines and mandatory surcharges on Vehicle and Traffic offenses. This Legislature further provides for increases in Justice Court fines for violations of the Environmental Conservation Law.

The Legislature accepts Executive Article VII legislation that would require certain felony offenders to pay a DNA databank fee. This legislation would also require sex offenders to pay an additional registration fee and a change of registration fee.

The Legislature accepts the Executive recommendation to increase the fingerprint fee for criminal history background checks.

The Legislature accepts the Executive recommendation to require holders of a Hazardous Materials (HAZMAT) license endorsement to undergo a criminal background check.
