Enacts the "health care decisions act for persons with mental retardation";
which provides for the certification, prior to the appointment of a guardian
for a mentally retarded person, of whether such person has the capacity to make
his or her own health care decisions; authorizes and regulates health care
decision making by guardians on behalf of mentally retarded persons; requires
guardians to make all decisions based upon the best interests of the mentally
retarded person; authorizes guardians to withhold or withdraw life sustaining
treatment under limited and restricted situations; provides for commencement of
a special proceeding to challenge the determinations of guardians.
