 BILL NUMBER:  A969

 TITLE OF BILL :  An act to amend the vehicle and traffic law, in
relation to the offense of aggressive driving

 PURPOSE : To create the offense of aggressive driving.

 SUMMARY OF PROVISIONS : Section one of this bill amends the vehicle
and traffic law by adding a new section 1212-a which defines
aggressive driving as recklessly operating a motor vehicle on a public
highway in a manner which creates a substantial risk of serious
physical injury to another person; or operating a motor vehicle on a
public highway while displaying a deadly weapon, dangerous instrument
or what reasonably appears to be a pistol, revolver, rifle, shotgun,
machine gun or other firearm in such a manner as to put another person
in reasonable fear of death or serious physical injury; or operating a
motor vehicle on a public highway in such a manner as to place another
person in reasonable fear of death or serious physical injury.
Violation of this section is a misdemeanor.

Section two amends subdivision (b) of section 1122 of the vehicle and
traffic law to make it a misdemeanor for a driver to deliberately
increase the speed of his or her vehicle when being overtaken by a
vehicle attempting to pass on the right.

Section three is the effective date.

 JUSTIFICATION : Many citizens are concerned that dangerous driving
behaviors are becoming more common and that accidents due to this
reckless behavior are increasing as well. This bill will help to
preserve public safety and enhance traffic enforcement.

 EFFECTIVE DATE : This act shall take effect on the first day of
November next succeeding the date on which it shall have become a law.
