  TITLE OF BILL: An act to amend the vehicle and traffic law, in relation to vehicle inspection renewal notification   PURPOSE OR GENERAL IDEA OF BILL: This bill would amend section 304 of vehicle and traffic law by adding a new subdivision where the Department of Motor Vehicles shall notify individuals via postal mail that their vehicle inspection is subject to expiration before such expiration.   SUMMARY OF SPECIFIC PROVISIONS: Section (1) Section 304 of the vehicle and traffic law is amended by adding a new subdivision (d) to read as follows: (d) The department of motor vehicles shall notify individuals via postal mail that their vehicle inspection is subject to expiration before such expiration. Every owner of a motor vehicle which shall be operated or driven upon the public highways of this state, except as otherwise expressly provided, shall be contacted by mail or otherwise. Section (2) This act shall take effect on the first of January next succeeding the, date on which it shall have become a law   JUSTIFICATION: This bill seeks to promote public safety by reminding a driver that their New York State Vehicle Inspection is close to expiration. Currently there is not a means to notify of impending inspection expira- tion; therefore, it is common that many people miss their inspection renewal date. A reminder would dive a warning notice to the motorist that it is time to take their vehicle in for the required yearly inspection. This would reduce the number of uninspected vehicles with possible malfunctioning equipment on public streets.   PRIOR LEGISLATIVE HISTORY: 2014: A.9100/Transportation   FISCAL IMPLICATIONS: None   EFFECTIVE DATE: This act shall take effect on the first of January next succeeding the date on which it shall have become a law.

        AN  ACT  to  amend  the  vehicle and traffic law, in relation to vehicle
          inspection renewal notification
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Section  304 of the vehicle and traffic law is amended by
     2  adding a new subdivision (d) to read as follows:
     3    (d) (1) The department of motor vehicles shall notify individuals  via
     4  postal  mail  that  their  vehicle  inspection  is subject to expiration
     5  before such expiration. Every owner of a motor vehicle  which  shall  be
     6  operated  or driven upon the public highways of this state shall, except
     7  as otherwise expressly provided, be contacted by mail or otherwise.
     8    (2) The renewal notification shall contain: (A) a brief description of
     9  the motor vehicle that has an  inspection  that  needs  to  be  renewed,
    10  including  the  name  and factory number of such vehicle, and such other
    11  facts as the commissioner shall require; (B)  the  name  and  residence,
    12  including  county of the owner of such motor vehicle, and (C) such addi-
    13  tional facts or evidence as the commissioner may require  in  connection
    14  with the letter of notification.
    15    (3)  The  commissioner  shall register the notification sent regarding
    16  such motor vehicle or trailer and maintain  a  record  of  such  renewal
    17  notifications and the addresses to which such notifications were sent.
    18    (4)  It  shall  be  the  duty  of every owner holding a certificate of
    19  registration to notify the commissioner in  writing  of  any  change  of
    20  residence  of  such person within ten days after such change occurs, and
    21  to inscribe on such certificate, in the place provided  by  the  commis-
    22  sioner, a record of such change of residence.
    23    (5)  Inspection  renewal  notifications  shall take effect on the date
    24  determined by the commissioner.

     1    (6) The commissioner may promulgate such regulations as are  necessary
     2  to  effectuate  the provisions of this subdivision, including provisions
     3  for the recovery of the administrative costs of the program incurred for
     4  each municipality.
     5    §  2. This act shall take effect on the first of January next succeed-
     6  ing the date on which it shall have become a law.
