shall be entitled to the same retirement system membership as such public
school employees are entitled.

 BILL NUMBER:  A1814

 TITLE OF BILL :  An act to amend the education law, in relation to
the rights of employees of charter schools; and to repeal paragraph
(b-1) of subdivision 3 of section 2854 of such law relating to
collective bargaining representation of employees of charter schools

 PURPOSE OR GENERAL IDEA OF BILL :  To provide that charter school
employees are entitled to the same collective bargaining
representation and retirement as public school employees.

 SUMMARY OF SPECIFIC PROVISIONS :  Paragraph (b) of subdivision 3 of
section 2854 of the Education Law is amended to specify that all
employees of newly created charter schools, as well as charter schools
that are converted from an existing public school, will be entitled to
the same representation as employees of the school district in which
the charter school is located. Paragraph (b-1) of subdivision 3 of
Section 2854 of the Education Law is repealed to conform with the
above amendment. Paragraph (c) of subdivision 3 of Section 2854 of the
Education Law is amended to require that employees of charter schools
must be members of the appropriate public retirement system.

 JUSTIFICATION :  This bill will protect the rights of employees of
charter schools throughout the state by ensuring that they are
entitled to the same union representation as employees of the school
district in which the charter school is located. Since charter school
employees are deemed public employees for the purposes of Article 14
of the Civil Service Law, they should be entitled to the same
collective bargaining rights, benefit enhancements and retirement
privileges that all other public education employees enjoy.
