  TITLE OF BILL: An act to amend the state finance law and the executive law, in relation to enacting the "American made flag act"   PURPOSE OR GENERAL IDEA OF BILL: To ensure that all American flags purchased for use by the State of New York are manufactured in the United-States of America.   SUMMARY OF PROVISIONS: Section one titles the bill the "American made flag act." Section two amends section 165 of the state finance law to require that all American flags purchased for display in State buildings are 100% made in the United States of America. Section three amends section 403 of the execu- tive law to require that all flags displayed at public buildings conform to the requirements of section 165 of the state finance law.Section four sets the enacting date.   JUSTIFICATION: The American Flag is one of the most universally recognized symbols representing the United States and the principles and freedoms upon which it was founded. It is estimated that New York spends nearly $3.6 million dollars every year on United States flags produced in other countries.. This bill would ensure that all United States flags purchased by New York State are, likewise, made in the United States.   PRIOR LEGISLATIVE HISTORY: 02/11/21 referred to governmental operations 01/05/22 referred to governmental operations   FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS: To be determined.   EFFECTIVE DATE: This act shall take effect on the one hundred eightieth day after it shall have become a law.

        AN ACT to amend the state finance law and the executive law, in relation
          to enacting the "American made flag act"
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. This act shall be known and may be cited as  the  "American
     2  made flag act".
     3    §  2.  Section 165 of the state finance law is amended by adding a new
     4  subdivision 9 to read as follows:
     5    9. Flags. Only flags, regardless of size, that are one hundred percent
     6  manufactured  in  the  United  States,  from  articles,  materials,   or
     7  supplies,  one  hundred percent of which are grown, produced or manufac-
     8  tured in the United States, may  be  purchased  for  use  by  the  state
     9  government.  For the purposes of this subdivision, the term "flag" shall
    10  have the same meaning as provided in subdivision  one  of  section  four
    11  hundred one of the executive law.
    12    §  3.  Section  403  of  the  executive law is amended by adding a new
    13  subdivision 22 to read as follows:
    14    22. All flags purchased and displayed at any public building shall  be
    15  made in the United States from American materials, as provided in subdi-
    16  vision nine of section one hundred sixty-five of the state finance law.
    17    § 4. This act shall take effect on the one hundred eightieth day after
    18  it shall have become a law.
