TITLE OF BILL:
An act to amend the executive law, in relation to the International
Swimming Pool and Spa Code
 
PURPOSE OR GENERAL IDEA OF BILL:
To direct the New York State Fire Prevention and Building Code Council
to conduct a study on successfully implementing International Swimming
Pool and Spa Code.
 
SUMMARY OF PROVISIONS:
Section 1. The Executive law is amended by amending section 375 of the
Executive Law by adding a new subsection 10.
Section 2. This act shall take effect immediately.
 
JUSTIFICATION:
With the increase in consumer demand for pool and spa installations
during the pandemic, it is even more critical that pools and spas are
designed and installed correctly, safely, and in an energy efficient
manner. The International Swimming Pool and Spa Code (ISPSC) is the only
,document which addresses all these issues, including barriers, entrap-
ment prevention, slopes and dimensions, exits, entries, as well as prod-
uct quality and energy efficiency in pool pumps and hot tubs.
The ISPSC, now in its fourth edition, is developed jointly by the Inter-
national Code Council (developers of the International Building and
Residential Codes) and the Pool and Hot Tub Alliance (PHTA), which is
the largest trade association and source for subject matter expertise in
the industry. It is written in language that is both easy to understand
and enforce.
Currently NJ, MA, RI NH and PA have all adopted statewide ISPSC Code,
and CT is close to final adoption. This legislation would direct the New
York State Fire Prevention and Building Code Council to conduct a study
of successful ISPSC implementation in New York.

AN ACT to amend the executive law, in relation to the International
Swimming Pool and Spa Code
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 375 of the executive law is amended by adding a new
2 subdivision 10 to read as follows:
3 10. To conduct and complete a study of successfully implementing
4 current International Swimming Pool and Spa Code should an act of the
5 legislature become law requiring such code be enacted. This study shall
6 take effect within one hundred eighty days of the effective date of this
7 act.
8 § 2. This act shall take effect immediately.
