  TITLE OF BILL: An act to amend the racing, pari-mutuel wagering and breeding law, in relation to permitting drug-free adhesive breathing devices   TITLE OF BILL: An act to amend the racing, pari-mutuel wagering and breeding law, in relation to permitting drug-free adhesive breathing devices   PURPOSE OR GENERAL IDEA OF BILL: To allow the use of any drug-free adhesive breathing devices that assists in the reduction of airway resistance within nasal cavity of a horse during any race meeting.   SUMMARY OF SPECIFIC PROVISIONS: Section 1. Adds a new section 218-A to racing, pari-mutuel wagering and breeding law, and provides that no such rules or powers shall prohibit the use of any drug-free adhesive breathing device, consisting of a nonirritating adhesive and constructed of United States food and drug administration approved medical-grade components, that assists in the reduction of airway resistance within the nasal cavity of a horse during any race meeting.   JUSTIFICATION: This bill will allow the use of drug-flee nasal strips on horses during any race meeting. After thorough studies, such devices have shown bene- ficial health attributes for racehorses and have proven not to be rele- vant factors in the outcome of races. The purpose of the drug free device is to help strengthen the health of race horses by significantly decreasing their breathing difficulties as they are designed to keep the horses' airways from becoming smaller during vigorous activities. For many horses, this significantly decreases the chances of bleeding into their lungs caused by exercise-induced pulmonary hemorrhages.   LEGISLATIVE HISTORY: A1672 2021-2022 referred to racing and wagering A3382 2019-2020 referred to racing and wagering A1743 2017/2018 referred to racing and wagering   FISCAL IMPLICATION: None to the state   EFFECTIVE DATE: This act shall take effect immediately.

        AN ACT to amend the racing, pari-mutuel wagering and  breeding  law,  in
          relation to permitting drug-free adhesive breathing devices
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1.   The racing, pari-mutuel  wagering  and  breeding  law  is
     2  amended by adding a new section 218-a to read as follows:
     3    §  218-a. Equipment regulated. Only equipment specifically approved by
     4  the stewards shall be worn or carried by a jockey or a horse in a  race;
     5  provided,  however,  the use of any drug-free adhesive breathing device,
     6  consisting of a non-irritating adhesive and constructed of United States
     7  food and drug  administration  approved  medical-grade  components  that
     8  assists in the reduction of airway resistance within the nasal cavity of
     9  a horse during any race meeting shall not be prohibited.
    10    § 2. This act shall take effect immediately.
