  TITLE OF BILL: An act to amend the environmental conservation law, in relation to making technical corrections providing for misdemeanor penalties for hunting, trapping, or fishing without a valid license   PURPOSE OR GENERAL IDEA OF BILL: to make a technical correction to current law which increases penalties for individuals who hunt, fish or trap with a revoked hunting, fishing, or trapping license.   SUMMARY OF SPECIFIC PROVISIONS: (1) Modifies subdivision 14 of section 71-0921 of the environmental conservation law, as added by chapter 532 of the laws of 2019 (2) Removes subparagraph one, two or four of paragraph b of 5 subdivi- sion one from the 2019 amendment and adds subdivision four.   JUSTIFICATION: In 2019 S.6557/ A.6219 was passed. This legislation amended the Environ- mental Conservation law to authorize misdemeanor penalties for hunting, fishing or trapping while in possession of a revoked or suspended license. The bill was intended to deter individuals from illegally hunt- ing, fishing or trapping. S.6557/ A.6219 amended the wrong section of law, and does not allow offenders to be charged with a misdemeanor as intended. Passing this bill will make a technical correction to the current law, to allow misdemeanor penalties for those who hunt, fish or trap with a suspended license.   PRIOR LEGISLATIVE HISTORY: A.8640 - 2022 - held in environmental conservation   FISCAL IMPLICATIONS: None.   EFFECTIVE DATE: This act shall take effect immediately.

        AN ACT to amend the  environmental  conservation  law,  in  relation  to
          making  technical  corrections providing for misdemeanor penalties for
          hunting, trapping, or fishing without a valid license

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Subdivision  14  of  section 71-0921 of the environmental
     2  conservation law, as added by chapter  532  of  the  laws  of  2019,  is
     3  amended to read as follows:
     4    14.  Violation  of  [subparagraph  one,  two or four of paragraph b of
     5  subdivision one] subdivision four of section  11-0719  of  this  chapter
     6  involving the revocation and suspension of hunting, trapping, or fishing
     7  licenses.  Each such misdemeanor shall be punishable by imprisonment for
     8  not  more  than  ninety days, or by a fine of not less than five hundred
     9  dollars nor more than one thousand dollars, or by both such imprisonment
    10  and fine.
    11    § 2. This act shall take effect immediately.
