TITLE OF BILL:
An act to amend the public service law, in relation to ensuring net
metering is maintained as a compensation floor for residential producers
of energy
 
PURPOSE OR GENERAL IDEA OF BILL:
This bill establishes net-energy metering as a compensation floor for
customer-generators of electricity.
 
SUMMARY OF PROVISIONS:
Section 1: Amends Subdivision 6 of section 66-j of the public service
law, as amended by chapter 355 of the laws of 2009.
Section 2: Amends Subdivision 6 of section 66-1 of the public service
law, as 11 amended by chapter 721 of the laws of 2006.
Section 3: Sets the Effective Date.

JUSTIFICATION:
On March 9th, 2017 the Public Service Commission announced new guide-
lines for Distributed Energy Resources that would replace Net-Energy
Metering with a "value stack". The variability proposed by this "value
stack" threatens the predictability of compensation for those New York-
ers who would invest in residential or community energy generation
systems. To maintain predictability for future investments in distrib-
uted energy resources, this legislation maintains Net-Energy Metering as
a compensation floor for customer-generators. This legislation does not
preclude the use of the "value stack" to provide incentive through
greater compensation for customer-generators to improve their system's
performance.

AN ACT to amend the public service law, in relation to ensuring net
metering is maintained as a compensation floor for residential produc-
ers of energy
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subdivision 6 of section 66-j of the public service law, as
2 amended by chapter 355 of the laws of 2009, is amended to read as
3 follows:
4 6. Electric restructuring. Notwithstanding the provisions of this
5 section, including, but not limited to paragraph (b) of subdivision
6 three of this section, a customer-generator shall comply with any appli-
7 cable determinations of the commission relating to restructuring of the
8 electric industry. However, customer-generators shall never be compen-
9 sated at a value less than would exist under net energy metering.
10 § 2. Subdivision 6 of section 66-l of the public service law, as
11 amended by chapter 721 of the laws of 2006, is amended to read as
12 follows:

14 section, including, but not limited to paragraph (c) of subdivision
15 three of this section, a customer-generator shall comply with any appli-
