  TITLE OF BILL: An act to amend the public authorities law, in relation to providing notifications for E-ZPass transactions   PURPOSE OR GENERAL IDEA OF BILL: Provides notifications for E-ZPass transactions   SUMMARY OF PROVISIONS: Section I: adds section 378-b to the public authorities law Section II: provides the effective date   JUSTIFICATION: As New York state advances into the 21st Century, so too must our agen- cy's notification systems for transactions. In the day and age where everyone is using their electronic devices to communicate, place orders for food and other items, and even do their banking, it's time that our toll system offer the same convenience. This bill would establish electronic notification requirements for toll- ing, whether by email, smart phone notification, or other electronic means, to help citizens interact with their government in real time, and ensuring that no one is surprised with massive fines, fees, or tolls due to delayed or mailed notifications.   PRIOR LEGISLATIVE HISTORY: 2021-22: A.8302   FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS: None   EFFECTIVE DATE: This act shall take effect on the one hundred eightieth day after it shall have become a law. Effective immediately, the addition, amendment and/or repeal of any rule or regulation necessary for the implementation of this act on its effective date are authorized to be made and completed on or before such date

        AN ACT to amend the public authorities law,  in  relation  to  providing
          notifications for E-ZPass transactions
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. The public authorities law  is  amended  by  adding  a  new
     2  section 378-b to read as follows:
     3    §  378-b.  E-ZPass  notifications.  1. The authority shall transmit an
     4  electronic notification to the holder of an electronic  toll  collection
     5  device  that  notifies  such  holder that he or she has passed through a
     6  toll plaza operated by the authority and a  transaction  has  posted  to
     7  such holder's account for his or her electronic toll collection device.
     8    2.  Such electronic notification shall be provided by electronic mail,
     9  text message or through a mobile application within twenty-four hours of
    10  a transaction posting to such holder's account, or as soon as  practica-
    11  ble if no valid account is recognized at the time of the transaction.
    12    3. A holder of an electronic toll collection device may:
    13    (a) opt out of receiving electronic notifications at any time;
    14    (b) opt in to receiving electronic notifications at any time; and
    15    (c)  be  required to confirm participation in the electronic notifica-
    16  tions program.
    17    4. The authority shall allow  a  person  without  an  electronic  toll
    18  collection device to opt in to receiving electronic notifications.
    19    5.  The authority shall promulgate any rules and necessary regulations
    20  to implement the provisions of this section.
    21    § 2. This act shall take effect on the one hundred eightieth day after
    22  it shall have become a law. Effective immediately, the addition,  amend-
    23  ment and/or repeal of any rule or regulation necessary for the implemen-
    24  tation  of  this act on its effective date are authorized to be made and
    25  completed on or before such date.
