  TITLE OF BILL: An act to amend the education law, in relation to limiting compensation of executives of charter schools where such compensation is provided through state funding   PURPOSE OR GENERAL IDEA OF BILL: Limits compensation of executives of charter schools where such compen- sation is provided through state.funding.   SUMMARY OF SPECIFIC PROVISIONS: Amends Section 2854 of the education law, relating to the general requirements for charter schools. It adds a new subsection stating that Compensation paid or given to executives of charter schools that are approved by the board of regents shall not exceed one-hundred and nine- ty-nine thousand dollars per year where such compensation is provided through state funding.   JUSTIFICATION: Executive order No.38 enacted by former Governor Cuomo, relating the use of public funds for the compensation of executives of Not for Profit organizations was the first piece of legislation to deal with this issue. It was hailed widely as an improvement by the Not for Profit sector but it did not relate at all to public funding for charter schools. As of right now, it is at the discretion of the board of char- ter schools as to how to spend public funds..While there are guidelines as to the use of this money, there is no legislation in place to cap funding to executives on these boards. As the nature of executive orders makes them subject to change, it is my belief that such provisions that are contained therein must be codified in law to ensure that such prob- lems do not arise again, and that charter schools are held publicly accountable for the use of public funds.   PRIOR LEGISLATIVE HISTORY: 2015-16: Referred to education 2017-18: Referred to education 2019-20: A.2534 Referred to education   FISCAL IMPLICATIONS: None for the state.   EFFECTIVE DATE: Effective from July 1, 2023

        AN ACT to amend the education law, in relation to limiting  compensation
          of  executives  of charter schools where such compensation is provided
          through state funding
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Section  2854 of the education law is amended by adding a
     2  new subdivision 4 to read as follows:
     3    4. Compensation of executives. Compensation paid or given to any exec-
     4  utive of a charter school approved by the board  of  regents  shall  not
     5  exceed  one  hundred  ninety-nine  thousand  dollars per year where such
     6  compensation is provided through state funding.
     7    § 2. This act shall take effect July 1, 2023.
