TITLE OF BILL:

PURPOSE:
Relates to authorizing a parking permit system for park-and-rides in the
Borough of Staten Island
 
SUMMARY OF PROVISIONS:
Section 1 amends the Vehicle and Traffic law by adding a new section
1640-q.
 
JUSTIFICATION:
This bill would implement a parking permit system for park-and-ride
parking lots located in Staten Island. The Borough of Staten Island has
three park and ride parking lots offer Staten Island commuters a
combined 1,157 parking spaces.
Recently, it seems that out-of-state residents are taking advantage of
the free parking at park-and-ride lots to the detriment of Staten Island
residents. This requires Staten Island residents often have to find less
convenient parking when parking spaces in park-and-ride lots are occu-
pied by out-of-state residents. The cost of operating and maintaining
park-and-ride parking lots on Staten Island is supplemented with revenue
collected from the taxes paid by Staten Island residents and other resi-
dents of the state of New York. This bill, by implementing a paid park-
ing permit system at Staten Island park-and-ride lots in which Staten
Island residents receive a permit free of charge and out-of-state resi-
dents pay an annual fee for a permit would increase the availability of
parking spaces for Staten Island residents.

AN ACT to amend the vehicle and traffic law, in relation to parking
permit systems for park-and-rides on Staten Island
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The vehicle and traffic law is amended by adding a new
2 section 1640-s to read as follows:
3 § 1640-s. Parking permit systems for park-and-rides on Staten Island.
4 1. Notwithstanding the provisions of any law to the contrary, the city
5 of New York may, by adoption of a local law or ordinance, provide for a
6 parking permit system for park-and-rides and fix and require the payment
7 of fees applicable to parking within the area in which such parking
8 system is in effect in accordance with the provisions of this section.
9 2. Such parking permit systems for park-and-rides shall only be estab-
10 lished within the borough of Staten Island for park-and-rides located
11 within such borough.
12 3. Residents of Staten Island shall receive a permit free of charge
13 and out-of-state residents shall pay an annual fee for such permit.
14 4. The local law or ordinance providing for such permit systems shall:
15 (a) set forth the factors which necessitate the enactment of such
16 permit system;
17 (b) provide that motor vehicles registered pursuant to section four
18 hundred four-a of this chapter shall be exempt from any permit require-
19 ment;
20 (c) provide the times of the day and the days of the week during which
21 permit requirements shall be in effect;
22 (d) provide the schedule of fees to be paid for the parking permits;
23 and
24 (e) provide that such fees shall be credited to the general fund of
25 the city.

1 5. No local law or ordinance shall be adopted pursuant to this section
2 until a public hearing thereon has been had in the same manner as
3 required for public hearings on a local law pursuant to the municipal
4 home rule law.
5 § 2. This act shall take effect immediately.
