TITLE OF BILL:
An act to amend the social services law, in relation to requiring child
day care centers, family day care homes, and any child day care provider
to notify the municipality in which they intend to operate of their
intent to request such a license or registration
 
PURPOSE OR GENERAL IDEA OF BILL:
Require that prior to requesting a license to operate a daycare, the
provider must notify the municipality in which they intend to operate.
 
SUMMARY OF PROVISIONS:
Section 1 - Prior to request a license or registration from the office
of children and family services, child day care centers, family day care
homes, and any child day care provider shall notify the municipality in
which they intend to operate of their intent to request such a license
or registration. This paragraph shall not apply to any child day care
centers, family day care homes, and child day care providers located
wholly within a city with a ' population of one million or more.
Section 2 - Effective Date.
 
JUSTIFICATION:
When someone wants to open a new daycare, they need to apply for a
license. Once the application has been submitted the applicant will
often times contact the municipality that they intend to operate in to
check the status of their application.'Currently, the municipalities are
unaware of the submission of these applications, as such they are unable
to help the applicant. This bill aims to fix that issue and to increase
transparency between the municipality and the appliCant in order to
establish a more mutually beneficial relationship with the community.

AN ACT to amend the social services law, in relation to requiring child

The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subdivision 2 of section 390 of the social services law is
2 amended by adding a new paragraph (f) to read as follows:
3 (f) Prior to requesting a license or registration from the office of
4 children and family services, child day care centers, family day care
5 homes, and any child day care provider shall notify the municipality in
6 which they intend to operate of their intent to request such a license
7 or registration. This paragraph shall not apply to any child day care
8 centers, family day care homes, and child day care providers located
9 wholly within a city with a population of one million or more.
10 § 2. This act shall take effect immediately.
