TITLE OF BILL : An act to amend the insurance law, in relation to
the renewal of health insurance policies for long term care
PURPOSE OR GENERAL IDEA OF BILL :
This bill would provide that health insurance contracts and policies
for long term care shall be renewable each year at the option of the
insured. This bill would provide that should the insured fail to pay
the premiums due for renewal, then the insurer may cancel the contract
or policy.
SUMMARY OF SPECIFIC PROVISIONS :
Paragraphs 5 and 6 of subsection (b) of section 1117 of the insurance
law are renumbered paragraphs 6 and 7 and a new paragraph 5 is added.
JUSTIFICATION :
The amendment protects the insured from an arbitrary termination of
coverage based on the whim of the insurer for any reason other than
non-payment of premiums.
