TITLE OF BILL:  An act to amend the tax law, in relation to allowing
modifications reducing federal adjusted gross income for purposes of
tax on personal income for the purchase and installation of farm waste
electric generating equipment

PURPOSE:
This bill seeks to use tax incentives to promote methane digesters as
a way to encourage onsite energy generation for dairy farms, and other
energy dependent agriculture operations with anaerobic digester
capabilities.

JUSTIFICATION:
Small scale anaerobic digesters have become increasingly economical as
the technology is improved and perfected.  These methane digesters are
capable of producing energy that can reduce the overhead of an
individual farm by drastically reducing its energy outside draw from
the grid. Digester also have an environmental impact on individual
farms, not just by reducing outside energy usage, but by creating an
end product that is more environmentally sound for the purposes of
spreading.

A tax incentive for individual farmers willing to install this
technology would allow the use of small-scale digester to spread
throughout the state, having a major impact on overall energy usage.

LEGISLATIVE HISTORY:
Introduced as S.5502 in 2007.

FISCAL IMPLICATIONS:
To be determined.

EFFECTIVE DATE:
This act shall take effect immediately and shall apply to taxable
years beginning on or after January 1, 2010.
