MEMORANDUM IN SUPPORT OF LEGISLATION

  TITLE OF BILL: An act to amend the workers' compensation law, in relation to paid fami- ly leave and siblings   PURPOSE OR GENERAL IDEA OF BILL: The purpose of this legislation is to add siblings to the definition of family member in relation to Paid Family Leave.   SUMMARY OF PROVISIONS: Section 1. A new subdivision 24 is added to Section 201 of the Workers' Compensation Law, which defines "sibling". Section 2. Subdivision 20 of section 201 of the Workers' Compensation Law is amended by adding "sibling" to the definition of "family member". Section 3. Establishes the effective date.   DIFFERENCE BETWEEN ORIGINAL AND AMENDED VERSION (IF APPLICABLE): The only change in the two versions is the effective date.   JUSTIFICATION: When we celebrate a marriage, birth or promotion, we often celebrate with our sibling(s). That is also true when we face hardships such as sickness. A concerned constituent shared their story with me, and explained how they were unable to tend to their sibling under New York State's current Paid Family Leave. The strong bond siblings share is undeniable, and for many single indi- viduals a sibling may be the only surviving family member that they have. Therefore, it is imperative that we add "sibling" to the defi- nition of "family member" for the purpose of Paid Family Leave.   PRIOR LEGISLATIVE HISTORY: A. 3640 and S. 7860 of 2019/2020   FISCAL IMPLICATIONS FOR STATE AND LOCAL. GOVERNMENTS: The exact cost is unknown however it is expected to be minimal.   EFFECTIVE DATE: This act shall take effect on the first of January following the first of September next succeeding the date on which it shall have become a law and shall apply to all policies or contracts issued, renewed, modi- fied, altered or amended on or after such date.

        AN ACT to amend the workers' compensation law, in relation to paid fami-
          ly leave and siblings
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Section 201 of the workers' compensation law is amended  by
     2  adding a new subdivision 24 to read as follows:
     3    24. "Sibling" means a biological or adopted sibling, a half-sibling or
     4  stepsibling.
     5    §  2.  Subdivision 20 of section 201 of the workers' compensation law,
     6  as added by section 2 of part SS of chapter 54 of the laws of  2016,  is
     7  amended to read as follows:
     8    20.  "Family  member"  means a child, parent, grandparent, grandchild,
     9  sibling, spouse, or domestic partner as defined in this section.
    10    § 3. This act shall take effect on the first of January following  the
    11  first  of  September  next  succeeding  the  date on which it shall have
    12  become a law and shall  apply  to  all  policies  or  contracts  issued,
    13  renewed, modified, altered or amended on or after such date.
