BILL NUMBER:A5810A

TITLE OF BILL:  An act to amend the public authorities law, in relation
to the submission of safety, security, and health reports and policies
by the metropolitan transportation authority

PURPOSE OR GENERAL IDEA: This bill would require the MTA to submit annu-
al reports on attacks, injuries or deaths reported to or otherwise known
to it in connection with its facilities and premises.

SUMMARY OF SPECIFIC PROVISIONS:  Adds a new section 1269-e to the public
authorities law that requires:

1) An annual report be submitted to the governor, speaker of the assem-
bly, and president of the senate on assaults and attacks on MTA employ-
ees, passengers, and other non-employees in connection with bus, subway,
and train equipment owned/operated by MTA or its subsidiaries. Addi-
tionally, the report shall provide recommendations to avoid or reduce
the frequency of such assaults and attacks.

2) An annual report be submitted to the governor, speaker of the assem-
bly, and president of the senate on injuries or deaths to employees,
passengers, and other non-employees caused by physical infrastructure,
safety, condition, security, or other health hazards identified by MTA
in connection with bus, subway, and train equipment owned/operated by
MTA or its subsidiaries. Additionally, the report shall provide recom-
mendations to avoid or reduce the frequency of such injuries.

JUSTIFICATION: By reporting instances of assaults, sexual assaults and
attacks and injuries from physical infrastructure, safety, condition,
security, and other health hazards on MTA employees, passengers and
other non-passengers, the MTA can establish a means for effective policy
to remediate such hazards to such people.

PRIOR LEGISLATIVE HISTORY: A.11568-A (2001-02), A-1312-A, passed Assem-
bly (2003-04), A.2101-A (2005-06). A.1545, passed Assembly 2007/2008).

FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS:  Minimal.
