  TITLE OF BILL: An act to authorize Kathleen M. Dalton to have mater- nity leave deemed as benefits eligible service for retiree health insur- ance purposes   PURPOSE: For retirement health insurance purposes   SUMMARY OF PROVISIONS: Section one, Notwithstanding any other provisions of law to the contra- ry, Kathleen M. Dalton, a member of the New York State employees' retirement system, employed from April 16, 1987 until June 12, 1997 and who took maternity leave from November 25, 1992 until February 11, 1993, shall be entitled to have such maternity leave credited and deemed as benefits eligible service for retiree health insurance purposes, provided she files a written request to that effect with the department of civil service within 90 days of the effective date of this act. Section two contains the effective date. JUSTIFICATION: Between the period of November 25, 1992 and February 11, 1993, New York State employee, Kathleen M. Dalton, took maternity leave for the birth of her son. She maintained her insurance coverage during that period. Unfortu- nately, her maternity leave was not counted as benefits eligible, even though she was paying for and receiving benefits and returned to work after the maternity leave.   LEGISLATIVE HISTORY: New bill   FISCAL IMPLICATIONS: None   EFFECTIVE DATE: This act shall take effect immediately.

        AN ACT to authorize Kathleen M. Dalton to have maternity leave deemed as
          benefits eligible service for retiree health insurance purposes
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1. Notwithstanding any other provisions of law to the contra-
     2  ry, Kathleen M. Dalton, a  member  of  the  New  York  state  employees'
     3  retirement  system, employed from April 16, 1987 until June 12, 1997 and
     4  who took maternity leave from November 25, 1992 until February 11, 1993,
     5  shall be entitled to have such maternity leave deemed as benefits eligi-
     6  ble service for retiree health insurance purposes, provided she files  a
     7  written  request  to  that  effect  with the department of civil service
