       AN  ACT  to amend the public health law, in relation to the provision of
         certain professional services to children's camps

         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:

    1    Section  1. Subdivision 3 of section 1394 of the public health law, as
    2  added by chapter 214 of the laws of 2012,is amended to read as follows:
    3    3. (A) Any person, firm, corporation, or association that  operates  a
    4  children's  overnight, summer day, or traveling summer day camp, and has
    5  obtained a permit pursuant to section thirteen hundred  ninety-three  of
    6  this  article,  shall  be authorized to employ or contract with a physi-
    7  cian, nurse practitioner,  physician  assistant,  registered  nurse,  or
    8  licensed  practical  nurse  or  emergency medical technician to act as a
    9  designated camp health director or to provide health services in assist-
   10  ance to the camp health  director  pursuant  to  applicable  regulations
   11  promulgated by the commissioner.
   12    (B)  ANY  NOT  FOR PROFIT CORPORATION THAT OPERATES A CHILDREN'S OVER-
   13  NIGHT, SUMMER DAY, OR TRAVELING SUMMER DAY CAMP THAT SERVES A POPULATION
   14  OF CAMPERS WITH SPECIAL NEEDS, AND HAS OBTAINED  A  PERMIT  PURSUANT  TO
   15  SECTION  THIRTEEN  HUNDRED  NINETY-THREE  OF  THIS ARTICLE AND ANY OTHER
   16  PERMITS AS REQUIRED BY LAW, SHALL BE  AUTHORIZED  TO  CONTRACT  WITH  AN
   17  OCCUPATIONAL  THERAPIST,  PHYSICAL THERAPIST, PHYSICAL THERAPIST ASSIST-
   18  ANT, PSYCHOLOGIST, SOCIAL  WORKER,  OR  MENTAL  HEALTH  PRACTITIONER  TO

        EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets

    1  PROVIDE  PROFESSIONAL  SERVICES  TO  SUCH  CAMPERS WITH SPECIAL NEEDS IN
    2  ASSISTANCE TO THE CAMP HEALTH DIRECTOR. THE  AUTHORIZATION  TO  CONTRACT
    3  AND  TO PROVIDE SERVICES, AS PROVIDED BY THIS PARAGRAPH, SHALL BE PURSU-
    4  ANT TO REGULATIONS PROMULGATED BY THE COMMISSIONER. FOR PURPOSES OF THIS
    5  PARAGRAPH  THE TERM "CAMPERS WITH SPECIAL NEEDS" SHALL MEAN CAMPERS WHO,
    6  BECAUSE OF A MENTAL OR PHYSICAL CONDITION, REQUIRE THE  SERVICES  OF  AN
    7  OCCUPATIONAL  THERAPIST,  PHYSICAL THERAPIST, PHYSICAL THERAPIST ASSIST-
    8  ANT, PSYCHOLOGIST, SOCIAL WORKER,  OR  MENTAL  HEALTH  PRACTITIONER  FOR
    9  THERAPEUTIC OR REHABILITATIVE PURPOSES AND SUCH SERVICES ARE REQUIRED IN
   10  ORDER FOR SUCH CAMPER TO ATTEND THE CAMP.
   11    S 2. This act shall take effect immediately.
