MEMORANDUM IN SUPPORT OF LEGISLATION

  TITLE OF BILL: An act to amend the social services law, in relation to creating the child care regulatory review task force   PURPOSE OR GENERAL IDEA OF BILL: To relieve unnecessary burdens on child day care providers so that they are better able to maintain a stable, quality program.   SUMMARY OF SPECIFIC PROVISIONS: Section one of the bill would create the Child Care Regulatory Review Task Force to review statutory and regulatory requirements for child day care providers. Section two of the bill would set forth the members of the Task Force: the Commissioner of the Office for Children and Family Services, the Commissioner of the Office of Temporary and Disability Assistance, the Commissioner of the Department of Health, the Commissioner of the Admin- istration for Children's Services and the Commissioner of the Department of Health and Mental Hygiene, or their designees. Section three of the bill would set forth the duties of the Task Force, including holding one public hearing, reviewing regulatory and statutory requirements and issuing a report with recommendations to the Legisla- ture three years from the effective date.   JUSTIFICATION: Child care providers experience administrative burdens as they work to maintain compliance with the various federal and state regulatory, licensing, and quality enhancement program requirements. Sometimes a provider may have to submit duplicative or very similar paperwork to multiple agencies. This can be time consuming and costly especially for small providers without the financial or personnel resources to dedicate to administrative activities. Depending on the circumstance, these obstacles may impose an unnecessary deterrent to maintaining a child care business. Therefore, this bill would create a task force of rele- vant State agencies to identify ways to streamline and reduce the exist- ing requirements.   PRIOR LEGISLATIVE HISTORY: 2013-14: A8924-A/S7192 Veto Memo 500   FISCAL IMPLICATIONS: Undetermined   EFFECTIVE DATE: Immediate.

        AN ACT to amend the social services law, in  relation  to  creating  the
          child care regulatory review task force
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. The social services law is amended by adding a new  section
     2  390-j to read as follows:
     3    §  390-j. The child care regulatory review task force. 1. Duties.  (a)
     4  Pursuant to the provisions of this section, the  child  care  regulatory
     5  review  task  force shall review processes and regulatory, statutory and
     6  programmatic requirements, placed on  child  care  providers  which  are
     7  regulated by the office of children and family services, that are dupli-
     8  cative  or  unnecessary and create administrative burdens for child care
     9  providers;
    10    (b) Hold, at minimum, one public hearing to obtain oral and/or written
    11  testimony from interested stakeholders;
    12    (c) Develop  and  propose  recommendations  for  the  streamlining  of
    13  current  processes  and requirements which are identified as duplicative
    14  or burdensome;
    15    (d) Such recommendations shall be submitted to the legislature annual-
    16  ly.
    17    2. Membership. (a) The task force shall consist of, at a minimum,  the
    18  commissioner  of the office of children and family services; the commis-
    19  sioner of the office of temporary and disability assistance; the commis-
    20  sioner of the department of health and the commissioner of the New  York
    21  city department of health and mental hygiene.
    22    (b)  The  members  of  the  child care regulatory task force shall not
    23  receive any compensation. However, the  members  shall  be  entitled  to
    24  reimbursement for any necessary expenses incurred in connection with the
    25  performance of their duties.

     1    3. Every state department, agency, division, board, bureau, commission
     2  and  any  other  relevant  entity shall provide all necessary assistance
     3  and/or information to the child care regulatory  review  task  force  to
     4  carry  out  its duties as authorized by subdivision one of this section,
     5  unless otherwise protected by law.
     6    4.  Any  information obtained by a member of the child care regulatory
     7  review task force while carrying out any duties as prescribed in  subdi-
     8  vision one of this section shall only be utilized in his or her capacity
     9  as a member of the child care regulatory review task force.
    10    § 2. This act shall take effect immediately.
