TITLE OF BILL:
An act to amend the alcoholic beverage control law, in relation to
prohibiting alcohol sales to persons inside of motor vehicles
 
PURPOSE:
This bill would prohibit the retail sale of alcoholic beverages to
customers who are inside of automobiles.
 
SUMMARY OF PROVISIONS:
Section 1 - Amends section 102 of the alcoholic beverage control law by
adding a new subdivision 9, which prohibits retail licensees from sell-
ing alcoholic beverages to individuals inside of motor vehicles
(as defined in vehicle and traffic law).
Section 2 - Effective date..
 
JUSTIFICATION:
"Drive-through" liquor stores are allowed in several states. In Louisia-
na, someone over 21 can even take advantage of drive-through frozen
daiquiris. Despite convenience, virtually no public policy argument can
reasonably be argued in favor of the drive-through sale of alcohol from
health, safety, and welfare perspectives.

AN ACT to amend the alcoholic beverage control law, in relation to
prohibiting alcohol sales to persons inside of motor vehicles
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 102 of the alcoholic beverage control law is
2 amended by adding a new subdivision 9 to read as follows:
3 9. No alcoholic beverage retail licensee shall sell any alcoholic
4 beverage to a person who is inside of a motor vehicle, as such term is
5 defined in section one hundred twenty-five of the vehicle and traffic
6 law, unless specifically authorized under this chapter to sell alcoholic
7 beverages for take-out.
8 § 2. This act shall take effect on the thirtieth day after it shall
9 have become a law.
