AN ACT to amend the public authorities law, in relation to the authority
to contract for energy
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 1005 of the public authorities law is amended by
2 adding a new closing paragraph to read as follows:
3 Notwithstanding any law, rule, regulation, policy, order or executive
4 action to the contrary, the authority shall not contract for or other-
5 wise purchase or acquire power or energy, or associated environmental
6 attributes, from any individual, trustee, partnership, association,
7 corporation, company, municipality, political subdivision or other legal
8 entity if such energy is transmitted over an electric transmission line,
9 including but not limited to a high voltage direct current electric
10 transmission line, that enters commercial operation after the effective
11 date of this paragraph and that interconnects a location outside the
12 territorial limits of the United States to a location within the state
13 and such transmission line does not provide access within the state to
14 electric generating facilities located within the state to transmit such
15 power or energy to a location within the state.
16 § 2. This act shall take effect immediately.
