MEMORANDUM IN SUPPORT OF LEGISLATION

  TITLE OF BILL: An act to amend the New York city charter, in relation to the Atlantic Yards arena and redevelopment project   PURPOSE OR GENERAL IDEA OF BILL: This bill would require that the Atlantic Yards arena and redevelopment project (as defined in an MOU signed with ESDC on February 18, 2005) be subject to ULURP.   SUMMARY OF SPECIFIC PROVISIONS: Section 1 of the bill sets out the legislative intent. Section 2 requires that the ULURP procedure as set forth in the City Charter not be circumvented due to the fact that an agency of the State (ESDC) is proposing to work with the private developer to build the Atlantic Yards project. Section 3 would require the Atlantic Yards project to be halted while the ULURP process was followed on an expedited schedule. Section 4 sets forth an expedited schedule for ULURP in this instance and requires a vote by the full City Council on those recommendations. Section 5 is the effective date.   JUSTIFICATION: The ULURP process was included in the City Charter by a vote of the citizenry of the city of New York to allow for a democrat- ically enacted urban land use procedure. This bill preserves that right in this instance which would otherwise be circumvented due to the fact that a state agency is involved in the planning and improvement of this parcel of land known as the Atlantic Yards arena and redevelopment project. Furthermore, community boards 2, 6 and 8 in Brooklyn have previously requested that this project be subject to the ULURP process.   PRIOR LEGISLATIVE HISTORY: A11394 of 2007-08 - referred to corpo- rations.
