MEMORANDUM IN SUPPORT OF LEGISLATION

  TITLE OF BILL: An act to amend the executive law, in relation to a prohibition on diversion of resources from dedicated funds derived from taxes and fees that support the metropolitan transportation authority or the New York city transit authority and their subsidiaries in certain instances   PURPOSE OR GENERAL IDEA OF BILL: The bill adds a new section 182 to the Executive law, a section that restricts the Governor's power to divert funds. The bill prohibits funds raised to support the MTA, the NYCTA or any of their subsidiaries from being diverted towards another purpose. The bill declares that the only condition where it is accepta- ble for these funds to be diverted is through legislation, and forbids the executive branch from doing so on its own. The funds affected are listed as including, but not limited to §§88-a and 89-c of the state finance law and chapter 25 of the Laws of 2009. Furthermore, the bill requires that if the Legislature chooses to pass legislation diverting such funds, it shall include a diversion impact statement.   JUSTIFICATION: This bill requires that these funds, which were put into law for the express purpose of funding the MTA or its subsidiaries, be used for their intended purpose. By retaining these funds for the system, we stabilize fares and protect funding for the system's opera- tion.   PRIOR LEGISLATIVE HISTORY: New bill.   FISCAL IMPLICATIONS TO STATE AND LOCAL GOVERNMENT: None.   EFFECTIVE DATE: Immediately.
