TITLE OF BILL:

PURPOSE OR GENERAL IDEA OF BILL:
Establishes the New York state digital payment application agency
acceptance task force.
 
SUMMARY OF PROVISIONS:
Section 1 establishes the task force, the number of members and their
duties. It also establishes who the task force required to collaborate
with and when the department of financial services shall submit a report
by.
Section 2 states that the act shall the effect immediately.
 
JUSTIFICATION:
New York State agencies collect fines, taxes, and payments throughout
its various systems. Currently our state accepts cash, checks, direct
check pay, debit and credit card payments. In today's economic environ-
ment, New Yorkers are making payments for goods and services by using
many digital payment applications. Many New York companies and organiza-
tions receive payments via applications such as Venmo, PayPal, Zelle,
Google Wallet, SquareCash, Applepay, and more. New York State should
make it easier to accept payments for receiving tax payments, register-
ing vehicles, and more. Therefore this bill will create a task force to
study how New York State can apply these digital applications to accept
funds.

AN ACT establishing the New York state digital payment application agen-
cy acceptance task force
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. 1. The department of financial services is hereby author-
2 ized to establish the New York state digital payment application agency
3 acceptance task force to provide the governor and the legislature with
4 information on the potential effects of state agencies accepting
5 payments via digital payment applications.
6 2. The task force shall be comprised of:
7 a. two members appointed by the governor;
8 b. two members appointed by the temporary president of the senate;
9 c. two members appointed by the speaker of the assembly;
10 d. one member appointed by the minority leader of the senate;
11 e. one member appointed by the minority leader of the assembly; and
12 f. two members appointed by the superintendent of financial services.
13 3. The task force shall:
14 a. identify what state agencies collect payments from individuals,
15 what such payments are collected for and through what mechanism such
16 payments are currently permitted to be made through;
17 b. examine and evaluate the availability, effectiveness, and trustwor-
18 thiness of digital payment applications including but not limited to,
19 Venmo, PayPal, Zelle, Google Wallet, Squarecash, and Applepay;
20 c. identify any state or federal agency that currently accepts digital
21 payment application payments and evaluate the effectiveness of such; and
22 d. make recommendations on how to effectively implement the practice
23 of digital payment application acceptance by state agencies.

1 4. Such task force shall collaborate with state and city of New York
2 agencies including, but not limited to, the department of taxation and
3 finance and the department of finance of the city of New York.
4 5. The department of financial services shall submit a report, on or
5 before January 1, 2025, to the governor and the legislature of its find-
6 ings, conclusions and recommendations, and legislative and regulatory
7 proposals deemed necessary to implement such recommendations.
8 § 2. This act shall take effect immediately.
