A01429 Memo:

BILL NUMBER:A1429

TITLE OF BILL: An act to amend the vehicle and traffic law, in relation
to refunds of registration fees and to repeal certain provisions of such
law relating thereto

PURPOSE:

To provide refunds to persons who do not use their registrations for the
full period and do not transfer their registrations to another vehicle.
Also provides prorated refund where persons transfer registration to a
lighter vehicle.

SUMMARY OF PROVISIONS:

Section 1 amends subdivision 2 of section 420 of the Vehicle and Traffic
Law. Section 2 amends subdivision 1 of section 428 of the Vehicle and
Traffic Law. Section 3 repeals subdivision 2 and adds a new subdivision
2 to provide pro-rata refund to persons as above.

STATEMENT OF SUPPORT:

Vehicle registration fees are based upon the weight of the vehicle being
registered for a period of two years. Failure to provide a proportional
refund is inequitable to persons who transfer their registration to
lighter weight vehicles during the course of the registration period or
who do not use the full period of registration. This bill would provide
that pro rata refunds be provided to affected persons.

LEGISLATIVE HISTORY:

2009-2010: A.717
2011-2012: A.1180

EFFECTIVE DATE: First of April next succeeding the date on which it
shall have become a law.
