  TITLE OF BILL: An act to amend the vehicle and traffic law, in relation to extending the timeframe for motor vehicle inspections for new motor vehicles sold within the state   PURPOSE OR GENERAL IDEA OF BILL: Extends the timeframe for motor vehicle inspections for new motor vehi- cles sold within the state   SUMMARY OF PROVISIONS: Section 1 subdivision (a) of section 301 of the vehicle and traffic law, as amended by chapter 429 of the laws of 1998   JUSTIFICATION: The safety features built into new cars and manufacturer reliability and warranties have greatly increased. New cars now monitor tire pressure, brake pad wear, oil life and more. Monitored systems on new cars alert the operator well ahead of time when these critical systems need repair. Therefore, extending the timeframe for new vehicles to have a valid inspection for 5 years from the date of new sale would help save the consumer money in the long run. But should the vehicle be involved in a reportable crash then there would be an exception to the five year non inspection period.   PRIOR LEGISLATIVE HISTORY: New bill.   FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS: To be determined.   EFFECTIVE DATE: This act shall take effect immediately.

ANGELINO, DeSTEFANO, DURSO, LEMONDES, MANKTELOW, McDONOUGH, MILLER, MORINELLO -- read once and referred to the Commit- tee on Transportation AN ACT to amend the vehicle and traffic law, in relation to extending the timeframe for motor vehicle inspections for new motor vehicles sold within the state The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision (a) of section 301 of the vehicle and traffic 2 law, as amended by chapter 429 of the laws of 1998, is amended to read 3 as follows: 4 (a) [The] (1) Other than new motor vehicles described under paragraph 5 two of this subdivision, the commissioner shall require that every motor 6 vehicle registered in this state be inspected once each year for safety, 7 and at least biennially for emissions as provided for pursuant to para- 8 graph two of subdivision (d) of this section, and in accordance with the 9 provisions of this article, and that every motor vehicle sold or trans- 10 ferred for use on the public highways of this state by a dealer regis- 11 tered under section four hundred fifteen of this chapter to any person 12 other than another such registered dealer or transferred for no remuner- 13 ation by such a registered dealer to any person other than to a welfare 14 to work program authorized by the New York state department of labor, a 15 private industry council, a county or a social services district for the 16 sole use of public assistance recipients or applicants participating in 17 the welfare to work program to which such vehicle is transferred must be 18 inspected and bear a valid certificate or certificates of inspection 19 prior to delivery to the purchaser or transferee. Provided, however, 20 that nothing contained herein shall be deemed to exempt any motor vehi- 21 cle so transferred to a welfare to work program pursuant to the 22 provisions of this subdivision from being inspected in accordance with 23 the provisions of this section or from complying with all other applica- EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD06602-01-3A. 2499 2 1 ble provisions of this chapter, including registration and financial 2 security, prior to operation on any public highway. 3 (2) Every new motor vehicle, as such term is defined under section 4 four hundred fifteen of this chapter, that is sold or transferred in New 5 York state to someone other than a distributor or dealer, shall be 6 inspected in accordance with the provisions of this section, however, 7 such inspection shall be valid for five years from the date of sale. 8 § 2. This act shall take effect immediately.
