TITLE OF BILL: An act to amend the executive law, in relation to
information on persons applying to be an auxiliary police officer
 
SUMMARY OF PROVISIONS:
This bill authorizes the Division of Criminal Justice Services to
perform background checks on those applying as auxiliary police officers
in local police departments. Amends Section 837-c subdivision b of the
executive law to allow police departments to forward descriptive data
and fingerprints of candidates for auxiliary police duty to D.C.J.S. for
processing
 
JUSTIFICATION:
Section 837-c of the executive law currently allows D.C.J.S. to perform
background checks on persons applying for employment with police depart-
ments. The language of this section, however, currently makes no
provision for similar checks to be performed on persons applying as
auxiliary police. Including auxiliary police officers among those eligi-
ble for background checks by D.C.J.S. would allow police departments to
properly screen candidates for auxiliary police.

AN ACT to amend the executive law, in relation to information on persons
applying to be an auxiliary police officer
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subdivision b of section 837-c of the executive law, as
2 added by chapter 482 of the laws of 1977, is amended to read as follows:
3 b. The police department may forward and the division shall receive,
4 process and, subject to subdivision e of this section, retain finger-
5 prints and such descriptive data as the division may require of persons
6 applying for employment or as an auxiliary police officer with such
7 department.
8 § 2. This act shall take effect immediately.
