        AN  ACT  to  amend  the vehicle and traffic law, in relation to creating

          exemption for certain military personnel  from  certain  training  and
          testing  requirements  in  order  to qualify for a commercial driver's
          license
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Section  502 of the vehicle and traffic law is amended by
     2  adding a new subdivision 4-a to read as follows:
     3    4-a. Exception for certain military  personnel.  Any  person  who  has
     4  successfully  completed  the  training  requirements  for and has been a
     5  United States army motor transport  operator  (MOS-88M),  United  States
     6  navy  motor vehicle operator (NEC-3531), United States air force vehicle
     7  operations (AFSC-2T1X1) or any other position as the United States army,

     8  navy or air force shall designate for like trained  military  personnel,
     9  shall  be deemed to have completed all training and testing requirements
    10  necessary for licensure under this section, except as such  requirements
    11  are  mandatory pursuant to public law 99-570, title XII, and title 49 of
    12  the code of federal regulations, and all regulations promulgated by  the
    13  United  States secretary of transportation under the hazardous materials
    14  transportation act.
    15    § 2. Paragraph (a) of subdivision 5 of section 502 of the vehicle  and
    16  traffic  law,  as amended by chapter 138 of the laws of 1981, is amended
    17  to read as follows:
    18    (a) Upon successful completion of the requirements set forth in subdi-
    19  vision four of this section or upon qualifying for the exception thereto

    20  set forth in subdivision four-a of this section, and upon payment of the
    21  fee prescribed by law,  the  commissioner  shall  issue  an  appropriate

     1  license  to  the  applicant,  except that the commissioner may refuse to
     2  issue such license
     3    §  3.  This  act shall take effect on the ninetieth day after it shall
     4  have become a law; provided, however, that  effective  immediately,  the
     5  addition,  amendment  and/or  repeal of any rule or regulation necessary
     6  for the implementation of this act on its effective date are  authorized

     7  and directed to be made and completed on or before such effective date.
