  TITLE OF BILL: An act to amend the education law, the state finance law and the real property tax law, in relation to charter schools; and to repeal paragraph (b-1) of subdivision 3 of section 2854 of the educa- tion law, relating to collective bargaining   PURPOSE: The bill states procedures for local approval of charter schools in certain school districts.   SUMMARY OF PROVISIONS: Charter schools shall be considered for approval if the applicant can demonstrate the ability to operate the school in an educationally sound manner; granting the application is likely to improve student learning and achievement and 'materially further the purpose set out in article 2852; the applicant has presented an economic impact study for the school district affected; the applicant has presented a financial impact statement on how the local school district will be impacted; and the applicant has conducted no less than three public hearings prior to approval.   JUSTIFICATION: It is imperative that our public school system not be based on a profit margin. This legislation would ensure that for-profit businesses or entities would not be allowed to' benefit from schools that are funded by public money.   PRIOR LEGISLATIVE HISTORY: 2002 - A9652 2003-2004 - A3944 2005-2006 - A4495 2007-2008 - A4873 2009-2010 - A6107 2011-2012 - A5257 2013-2014 - A1946   FISCAL IMPACT: None to the State.   EFFECTIVE DATE: This act shall take effect on the first of July next succeeding the date on which it shall have become law, provided that the amendments to subdivision 1 of section 2856 of the education law made by section six of this act shall not affect the expiration of such subdivision and shall expire therewith.
