  TITLE OF BILL: An act to amend the alcoholic beverage control law, in relation to a license to sell liquor at retail for consumption on certain premises   PURPOSE: This bill will allow for a restaurant, Golden Blue Bar & Restaurant Inc, to obtain a full liquor license. The bill will amend the ABC 20C-foot Law which will authorize the issuing of a retail liquor license to this business in the County of Kings, that is within a two-hundred-foot prox- imity of a religious teaching institution.   SUMMARY OF PROVISIONS: Section 1. Is amended to authorize the issuance for a retail license for Golden Blue Bar & Restaurants at its current location.   JUSTIFICATION: Golden Blue Bar & Restaurant Inc. applied for a liquor license which took a long time to process due to the pandemic and was later denied. Due to the existing ABC 200-foot law, this establishment has been restricted in fully serving its customers which makes it a challenge to compete, thus impacting the future of business. Further-more, the reli- gious institution which is within 200-feet, on 1143 Flatbush Avenue, has expressed that they have no objections to the request to apply for a full liquor license. An exemption to the ABC 200-foot Law would allow Golden Blue Bar .& Restaurant Inc. to operate with a full liquor license they will be able to meet the needs of the Community and attract more patrons.   LEGISLATIVE HISTORY: New Bill   FISCAL IMPLICATIONS: None.   EFFECTIVE DATE: This act shall take effect immediately.

        AN ACT to amend the alcoholic beverage control law,  in  relation  to  a
          license to sell liquor at retail for consumption on certain premises
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Subdivision 7 of  section  64  of  the  alcoholic  beverage
     2  control  law  is  amended  by  adding  a new paragraph (e-15) to read as
     3  follows:
     4    (e-15) Notwithstanding the provisions of paragraph (a) of this  subdi-
     5  vision,  the  authority  may  issue  a  retail  license  for on-premises
     6  consumption for a premises which shall be  located  within  two  hundred
     7  feet  of  a  building  occupied as a church, synagogue or other place of
     8  worship, provided such premises constitute a premises for  the  sale  of
     9  food  or  beverages  at  retail  for consumption on the premises located
    10  wholly within the boundaries of  the  borough  of  Brooklyn,  county  of
    11  Kings, bounded and described as follows:
    12    ALL  that  certain  plot,  piece or parcel of land, situate, lying and
    13  being in the Borough of Brooklyn, County of Kings, City and State of New
    14  York, bounded and described as follows:
    15    BEGINNING at the corner formed by intersection of the easterly side of
    16  Flatbush Avenue and the southerly side of Clarendon road;
    17    RUNNING THENCE easterly along the southerly side  of  Clarendon  Road,
    18  100 feet;
    19    THENCE  southerly  parallel with Flatbush Avenue, 21 feet 1-3/4 inches
    20  to a point distant 20 feet southerly from the southerly side of  Claren-
    21  don Road, measured on a line at right angles thereto;
    22    THENCE  westerly  and  parallel  with  Clarendon  Road and part of the
    23  distance through a party wall, 100 feet to the easterly side of Flatbush
    24  Avenue;
 
         EXPLANATION--Matter in italics (underscored) is new; matter in brackets
                              [ ] is old law to be omitted.
