  TITLE OF BILL: An act to amend the public officers law, in relation to qualifications for holding the offices of city controller and city engineer in the city of Amsterdam   PURPOSE OR GENERAL IDEA OF BILL: This legislation will allow the City of Amsterdam to hire an individual residing outside of the City of Amsterdam for the positions of city controller and city engineer, provided that the individual resides in MontgOmery County or an adjoining county within the State of New York.   SUMMARY OF PROVISIONS: Section 3 of the public officers law is amended by adding a new subdivi- sion 73 which allows an individual residing outside of the City of Amst- erdam, either within Montgomery County or an adjoining county, to hold the office of city controller or city engineer.   JUSTIFICATION: This legislation will increase the pool of candidates eligible to hold the offices. of City Controller and City Engineer. The Amsterdam Common Council and Mayor of Amsterdam have submitted a home rule request.   PRIOR LEGISLATIVE HISTORY: None.   FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS: None.   EFFECTIVE DATE: This act shall take effect immediately.

        AN ACT to amend the public officers law, in relation  to  qualifications
          for  holding  the  offices of city controller and city engineer in the
          city of Amsterdam

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section 1. Section 3 of the public officers law is amended by adding a
     2  new subdivision 73 to read as follows:
     3    73.  In  the  city  of  Amsterdam,  in  the  county of Montgomery, the
     4  provisions of this section requiring a person to be a  resident  of  the
     5  political subdivision or municipal corporation of the state for which he
     6  or she shall be chosen or within which his or her official functions are
     7  required  to  be  exercised, shall not prevent a person from holding the
     8  office of city controller or city engineer in  the  city  of  Amsterdam,
     9  provided  that  such person resides in Montgomery county or an adjoining
    10  county within the state of New York; provided, however that  any  person
    11  performing such functions or holding such office in any other city shall
    12  be a resident of such city unless otherwise provided by law.
    13    § 2. This act shall take effect immediately.
