Provides that the terms of office of the trustees of the public library district of the town of Esopus, Ulster county, shall commence on the fifteenth day of June next following their election; provides that trustees elected to fill vacancies shall serve for terms of three years.

AN ACT to amend chapter 43 of the laws of 1994 relating to establishing
a public library district in the town of Esopus, Ulster county, in
relation to the time of commencement and expiration of the terms of
office of the trustees of such district
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 3 of chapter 43 of the laws of 1994 relating to
2 establishing a public library district in the town of Esopus, Ulster
3 county, as amended by chapter 438 of the laws of 2000, is amended to
4 read as follows:
5 § 3. Organization and structure. a. The Town of Esopus public library
6 district shall be managed, operated and controlled by a board of trus-
7 tees consisting of nine members. These trustees shall at the first regu-
8 lar meeting of the board determine by lot the year in which each of
9 their terms of office expire, and the terms shall expire as follows:
10 After one year - two trustees; after two years - two trustees; after
11 three years - one trustee; after four years - two trustees; after five
12 years - two trustees. As vacancies occur trustees shall be elected at
13 the annual election herein provided for to serve for three year terms by
14 the voters of the library district hereby created, said terms to
15 commence on the [first] fifteenth day of June next following the
16 election. Only qualified voters of the district shall be eligible for
17 election to the board of trustees. The board of trustees at its first
18 meeting each year shall elect or appoint a president and vice-president
19 who shall be members of the board and a clerk, treasurer and such other
20 officers as they deem necessary. If the board so determines, the offices
21 of clerk and treasurer may be held by individuals who are not members of
22 the board of trustees, and in that event, these officers may, if the

1 board so determines, receive compensation as fixed by resolution of the
2 board.
3 b. Notwithstanding any other provision of law, the terms of office for
4 all of the trustees on the board of the town of Esopus public library
5 district prior the effective date of this subdivision as evidenced by a
6 certificate of the result of the canvass filed with the town clerk of
7 the town of Esopus shall terminate on June fifteenth of the last year of
8 their term instead of the first day of September.
9 § 2. This act shall take effect June 1, 2001; provided, however, that
10 if it shall have become a law after such date, it shall be deemed to
11 have been in full force and effect on and after June 1, 2001.
