        AN ACT to amend the public health law, in relation to community paramed-
          icine services provided by emergency medical providers
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1. Section 3000 of the public health law is amended by adding
     2  a third undesignated paragraph to read as follows:
     3    The purpose of this article is also to improve the health of  individ-
     4  uals in community settings by authorizing emergency medical technicians,
     5  working under medical control, to perform services that are within their
     6  scope  of  practice, education and training, in circumstances other then
     7  the initial emergency medical care and transportation of sick or injured
     8  persons.
     9    § 2. Subdivision 15 of section 3001  of  the  public  health  law,  as
    10  amended  by  chapter  445  of  the  laws  of 1993, is amended to read as
    11  follows:
    12    15. "Medical control" means: (a) advice and direction  provided  by  a
    13  physician  or  under  the  direction  of  a physician to certified first
    14  responders, emergency medical technicians or advanced emergency  medical
    15  technicians  who are providing medical care at the scene of an emergency
    16  or en route to a health care facility, or in community paramedicine; and
    17  (b) indirect medical control including the written policies, procedures,
    18  and protocols for prehospital emergency medical care and transportation,
    19  or in community paramedicine, developed by the state  emergency  medical
    20  advisory  committee,  approved  by  the state emergency medical services
    21  council and the commissioner, and implemented by regional medical  advi-
    22  sory committees.
    23    §  3. Section 3001 of the public health law is amended by adding a new
    24  subdivision 22 to read as follows:

     1    22. "Community  paramedicine"  means  the  practice  by  an  emergency
     2  medical  technician,  in the course of his or her work as an employee or
     3  member of an ambulance service or advanced life support  first  response
     4  service,  in  a setting other than a general hospital, and under medical
     5  control, of evaluating, preventing, or improving the health condition of
     6  an  individual,  within the scope of practice, education and training of
     7  the emergency  medical  technician,  in  circumstances  other  than  the
     8  initial  emergency  medical  care  and transportation of sick or injured
     9  persons.
    10    § 4. The public health law is amended by adding a new  section  3005-c
    11  to read as follows:
    12    §  3005-c. Community paramedicine. An emergency medical technician may
    13  provide community paramedicine services pursuant to regulations  by  the
    14  commissioner providing for oversight of a community paramedicine program
    15  to  be  provided  by an ambulance service or advanced life support first
    16  response service; governing community paramedicine; and requirements for
    17  community paramedicine programs to  provide  data  and  reports  to  the
    18  commissioner  concerning  community paramedicine.  In making regulations
    19  under this section, the  commissioner  shall  consult  with  appropriate
    20  stakeholders.
    21    § 5. This act shall take effect immediately.
