TITLE OF BILL: An act to amend the executive law, in relation to the
posting of the New York code, rules and regulations on the internet
 
PURPOSE OR GENERAL IDEA OF THE BILL: This bill would give citizens and
businesses ready internet access to the New York Code, Rules and Regu-
lations ("NYCRR"). While New York's statutes and constitution are easily
accessible on the internet, the NYCRR is not. Some state agency
websites maintain links to relevant portions of the NYCRR, but others do
not; none give access to the entire NYCRR. The NYCRR contains the rules
and regulations which state agencies follow in executing their respec-
tive responsibilities, and in many cases are more essential to the oper-
ation of government than the statutes which the NYCRR executes. Citizens
and businesses should have ready internet access to the laws which
govern them.
 
SUMMARY OF SPECIFIC PROVISIONS: The bill amends the Executive Law by
adding a new section 106-a, which would require the Department of State
to post or maintain a link on its website to an unofficial version of
the New York Codes, Rules and Regulations, at no cost to the public, and
to further require agency websites to maintain a link to the Department
of State website which contains the link to the unofficial version of
the New York Codes, Rules and Regulations.

AN ACT to amend the executive law, in relation to the posting of the New
York code, rules and regulations on the internet
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The executive law is amended by adding a new section 106-a
2 to read as follows:
3 § 106-a. Internet access to the New York code, rules and regulations.
4 The department of state shall post or maintain a link on its website to
5 an unofficial version of the New York codes, rules, and regulations,
6 which shall be provided at no cost to the end users. All state agencies
7 which have adopted rules and regulations shall maintain a link to the
8 department of state website which contains such link.
9 § 2. This act shall take effect January 1, 2008.
