Relates to prohibiting smoking in and on the premises of public housing accommodations; provides that by January 1, 2020, all public housing accommodations shall be classified as smoke-free.

AN ACT to amend the public housing law, in relation to prohibiting smok-
ing on the premises of public housing units
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The public housing law is amended by adding a new section
2 223-c to read as follows:
3 § 223-c. Prohibition on smoking. 1. Smoking shall be prohibited in or
4 on the grounds of any public housing accommodation classified by the
5 commissioner as a smoke-free building. The commissioner shall ensure
6 that at least fifty percent of all public housing accommodations in
7 existence as of the effective date of this section shall be classified
8 as smoke-free buildings.
9 2. Any public housing accommodation constructed after the effective
10 date of this section shall be classified as a smoke-free building. Smok-
11 ing shall be prohibited in and on the grounds of any of these accommo-
12 dations.
13 3. Any vacancies in a public housing unit that has been classified as
14 a smoking unit shall be reclassified as a smoke-free unit prior to any
15 new tenant taking occupancy. Smoking shall be prohibited in any of these
16 units on and after the date of such new occupancy.
17 4. On January first, two thousand twenty, the commissioner shall clas-
18 sify all public housing accommodations as smoke-free buildings. Smoking
19 shall be prohibited in and on the grounds of all public housing accommo-
20 dations on and after such date.

1 5. For purposes of this section, the term smoking shall include, but
2 not be limited to, the smoking or use of: (a) cigarettes, cigars, pipes
3 or any other handheld device used for the smoking of tobacco products;
4 and (b) electronic cigarettes, e-cigarettes, any electronic nicotine
5 delivery system or any other handheld electronic device that vaporizes a
6 flavored liquid.
7 § 2. This act shall take effect immediately.
