TITLE OF BILL:
An act to amend the vehicle and traffic law, in relation to including in
facilitating aggravated unlicensed operation of a motor vehicle consent-
ing to the operation of a motor vehicle by a person who is less than
eighteen years of age who has never had a license
 
PURPOSE OR GENERAL IDEA OF BILL:
This legislation will amend the vehicle and traffic law to include
facilitating aggravated unlicensed operation of a motor vehicle consent-
ing to the operation of a motor vehicle by a person who is less than
eighteen years of age who has never had a license.
 
SUMMARY OF PROVISIONS:
Section 1 amends section 511-a of the vehicle and traffic law to include
language stipulating that a person is guilty of the offense of facili-
tating aggravated unlicensed operation of a motor vehicle when a person
who is less than eighteen years old who has never had a license or the
privilege of operating such motor vehicle in New York and the vehicle is
operated upon a public highway by such person resulting in physical
injury to another person.
Section 2 sets the effective date.

JUSTIFICATION:
Holding individuals accountable for facilitating the unauthorized opera-
tion of a motor vehicle my minors is crucial for ensuring road safety.
Allowing someone under the age of 18, who has never held a license, to
operate a vehicle without proper authorization poses significant risks
to both the minor and others on the road. Allowing unlicensed minors to
operate motor vehicles with zero supervision can lead to accidents,
injuries and potential legal ramifications. By explicitly addressing the
issue of facilitating unlicensed operation of a motor vehicle by minors
in the law, this bill acts as a preventative measure. It sends a clear
message about the legal responsibilities of individuals regarding the
operation of motor vehicles, emphasizing the important of ensuring only
properly licensed individuals operate vehicles on public roads.

AN ACT to amend the vehicle and traffic law, in relation to including in

The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subdivision 1 of section 511-a of the vehicle and traffic
2 law, as amended by chapter 606 of the laws of 1993, is amended to read
3 as follows:
4 1. A person is guilty of the offense of facilitating aggravated unli-
5 censed operation of a motor vehicle in the third degree when such person
6 consents to the operation upon a public highway of a motor vehicle
7 registered in such person's name knowing or having reason to know that
8 the operator of such vehicle:
9 (a) is a person whose license or privilege of operating such motor
10 vehicle in this state or privilege of obtaining a license issued to
11 operate such motor vehicle by the commissioner is suspended, revoked or
12 otherwise withdrawn by the commissioner and the vehicle is operated upon
13 a public highway by such person; or
14 (b) is a person who is less than eighteen years of age who has never
15 had a license or the privilege of operating such motor vehicle in this
16 state and the vehicle is operated upon a public highway by such person
17 resulting in physical injury to another person.
18 § 2. This act shall take effect on the first of November next succeed-
19 ing the date on which it shall have become a law. Effective immediately,
20 the addition, amendment and/or repeal of any rule or regulation neces-
21 sary for the implementation of this act on its effective date are
22 authorized to be made and completed on or before such effective date.
