        Introduced by M. of A. BRINDISI -- read once and referred to the Commit-
          tee on Higher Education -- committee discharged, bill amended, ordered
          reprinted as amended and recommitted to said committee
 
        AN ACT to amend the education law, in relation to the matching award and
          tuition requirements of enhanced tuition awards

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Subdivisions 4, 5 and 6 of section 667-d of  the  education
     2  law,  as  added  by  section  1 of part III of chapter 59 of the laws of
     3  2017, are amended to read as follows:
     4    4. Amount. Within the  amounts  appropriated  therefor  and  based  on
     5  availability  of  funds,  awards shall be granted beginning with the two
     6  thousand seventeen--two thousand eighteen academic year  and  thereafter
     7  to  applicants  that  the  corporation  has  determined  are eligible to
     8  receive such awards. The amount of the award under this program shall be
     9  such that the sum of the  award  plus  a  student's  tuition  assistance
    10  program  award  pursuant  to  section  six  hundred  sixty-seven of this
    11  subpart plus the institution's matching award  pursuant  to  subdivision
    12  five  of this section shall equal six thousand dollars.  Any institution
    13  that has lowered its tuition by more than fifteen percent over the  last
    14  five  years  shall be exempt from having to provide such match until two
    15  thousand twenty-six and provided that such  amount  of  award  shall  be
    16  adjusted as if such match had been provided.
    17    5.  Matching  awards.  Commencing with the two thousand seventeen--two
    18  thousand eighteen academic year  and  thereafter,  participating  insti-
    19  tutions  shall  credit each recipient's remaining tuition expenses in an
    20  amount equal to the recipient's award under this  section.  Such  credit
    21  shall  be  applied after the recipient has received an institutional aid
    22  package, if any, to ensure that this program does  not  reduce  institu-
    23  tional  aid  that  would  otherwise be granted. Any institution that has
    24  lowered its tuition by more than fifteen  percent  over  the  last  five

     1  years  shall be exempt from having to provide such match until two thou-
     2  sand twenty-six.
     3    6.  Tuition. The rate of tuition charged to an individual receiving an
     4  award shall not be increased for the duration of time that such individ-
     5  ual receives an award. Provided, however, that such requirement  not  to
     6  increase  tuition  shall  be waived for any institution that has lowered
     7  its tuition by more than fifteen  percent  over  the  last  five  years,
     8  provided  that  the  tuition  level  charged  by such institution is not
     9  increased by more than three percent per year over the next nine years.
    10    § 2. This act shall take effect immediately.
