Relates to the administration of the Gold Coast public library district; provides that elections for vacancies on the board shall be held during the first fifteen days of September; provides that the fiscal year shall begin January 1; provides that certain provisions of the education law shall be applicable to such district.

AN ACT to amend chapter 233 of the laws of 2000 relating to authorizing
the town boards of the towns of Oyster Bay and North Hempstead, county
of Nassau, to establish the Gold Coast public library district, in
relation to the administration of the Gold Coast public library
district
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subdivision 3 of section 3 of chapter 233 of the laws of
2 2000 relating to authorizing the town boards of the towns of Oyster Bay
3 and North Hempstead, county of Nassau, to establish the Gold Coast
4 public library district, is amended to read as follows:
5 3. Candidates for the office of member of the board of trustees of the
6 library district shall be nominated by petition. A separate petition
7 shall be required to nominate each candidate for a vacancy on the board.
8 Each petition shall be directed to the town clerk of Oyster Bay, shall
9 be signed by at least fifty qualified voters of the district, shall
10 state the residence of each signer, and shall state the name and resi-
11 dence of the candidate. In the event that any such nominee shall with-
12 draw candidacy prior to the election, such person shall not be consid-
13 ered a candidate unless and until a new petition nominating such person
14 in the same manner and within the same time limitation applicable to
15 other candidates is filed with the town clerk of the town of Oyster Bay.
16 Each petition shall be filed with the town clerk of Oyster Bay between
17 the hours of 9:00 a.m. and 5:00 p.m., not later than the thirteenth day
18 preceding the election at which time the candidates nominated are to be
19 elected. In the event the district is created, petitions nominating
20 candidates for the board of trustees after the initial election shall be

1 filed with the secretary of the Gold Coast public library district or
2 his or her designee.
3 § 2. Section 4 of chapter 233 of the laws of 2000 relating to author-
4 izing the town boards of the towns of Oyster Bay and North Hempstead,
5 county of Nassau, to establish the Gold Coast public library district,
6 is amended to read as follows:
7 § 4. Organization and structure. The library district shall be
8 managed, operated and controlled by a board of trustees consisting of
9 nine members. The trustees shall at the first regular meeting of the
10 board determine when terms of office of each member shall expire. The
11 term of three trustees shall expire on the last day in the second Decem-
12 ber after the establishment of the library district and each year there-
13 after the term of three trustees shall expire. As vacancies occur trus-
14 tees shall be elected at an annual election to be held [on the first
15 Tuesday in the month of December] within the first fifteen days of
16 September, as determined year to year by the board of trustees. Only
17 qualified voters of the district shall be eligible for election to the
18 board of trustees. The board of trustees at its first meeting each year
19 shall elect or appoint a president and vice-president who shall be
20 members of the board and a secretary, treasurer and such other officers
21 as they deem necessary. If the board so determines, the offices of
22 secretary and treasurer may be held by individuals who are not members
23 of the board of trustees and, in that event, such officer may, if the
24 board so determines, receive compensation as fixed by resolution of the
25 board.
26 § 3. Subdivision 2 of section 5 of chapter 233 of the laws of 2000
27 relating to authorizing the town boards of the towns of Oyster Bay and
28 North Hempstead, county of Nassau, to establish the Gold Coast public
29 library district, is amended to read as follows:
30 2. The board of trustees shall, in accordance with the provisions of
31 section 104 of the town law, annually file with the clerk of each of the
32 municipalities within the district on or before the [first] twentieth
33 day of [February] September an estimate of the proposed budget including
34 costs of providing library services to be raised by levy for the library
35 district in the fiscal year beginning on the first day of [July of that]
36 January of the next succeeding year. The municipalities shall not make
37 any change in the estimate of revenues or expenditures submitted by the
38 board of the library district in preparation of its preliminary budget.
39 § 4. Section 5 of chapter 233 of the laws of 2000 relating to author-
40 izing the town boards of the towns of Oyster Bay and North Hempstead,
41 county of Nassau, to establish the Gold Coast public library district,
42 is amended by adding a new subdivision 6 to read as follows:
43 6. The town boards of the towns of Oyster Bay and North Hempstead,
44 shall have the power to authorize, sell, and issue bonds, notes, and
45 other evidences of indebtedness pursuant to the local finance law in
46 order to permit the library district to provide facilities or improved
47 facilities for library purposes. Upon written request from the board of
48 trustees of the Gold Coast public library district, after approval by
49 the qualified voters of such district, the town boards of the towns of
50 Oyster Bay and North Hempstead shall authorize, sell, and issue such
51 bonds, notes, or other evidences of indebtedness as are necessary to
52 accomplish the improvements specified in the notice. The proceeds of
53 such bonds, notes, or other evidences of indebtedness shall be paid to
54 the treasurer of the Gold Coast public library district and maintained
55 in a segregated account in accordance with section 165.00 of the local

1 finance law and expended by the treasurer only on specific authorization
2 by the board of trustees.
3 § 5. Section 8 of chapter 233 of the laws of 2000 relating to author-
4 izing the town boards of the towns of Oyster Bay and North Hempstead,
5 county of Nassau, to establish the Gold Coast public library district,
6 is renumbered section 9 and a new section 8 is added to read as follows:
7 § 8. Education law. Except as otherwise provided by this act, the
8 provisions of the education law relating to public libraries shall be
9 applicable to the Gold Coast public library district.
10 § 6. This act shall take effect immediately.
