A08800 Memo:

BILL NUMBER:A8800

TITLE OF BILL: An act to amend the public service law, in relation to
fuel cell electric generating equipment

PURPOSE:

To allow non-residential customer generators who are utilizing net
metering for fuel cell electric generating equipment to install
systems of up to 2,000 kilowatts.

SUMMARY OF SPECIFIC PROVISIONS:

Section 1-amends section 66-J of the public service law to increase
the rated capacity of fuel cell electric generating equipment for
non-residential customers from 1500 kilowatts to 2000 kilowatts.

Section 2-Sets forth the effective date.

JUSTIFICATION:

Fuel cell- electric generating equipment for non-residential customers
was added to the technologies authorized to conduct net metering by
chapter 530 of the laws of 2011. However, this chapter placed the
upper limit in terms of rated capacity at 1500 kilowatts, which is
wholly inconsistent with other technologies that are authorized for
net metering. Therefore, this bill aims to level the playing field by
moving the upper rated capacity for fuel cells from 1500 kilowatts to
2000 kilowatts. This assures parity between fuel cells and other clean
energy technologies.

FISCAL IMPLICATIONS:

None
