       Introduced  by  M.  of  A.  PALMESANO  --  read once and referred to the
         Committee on Codes

       AN ACT to amend the criminal procedure law, in relation  to  designating
         Yates  county  court  security officers and animal control officers as
         peace officers

         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:

    1    Section  1.  Subdivision  70 of section 2.10 of the criminal procedure
    2  law, as added by chapter 555 of the laws of 1997 and  as  renumbered  by
    3  chapter 385 of the laws of 2000, is amended to read as follows:
    4    70.  Employees  appointed  by the sheriff of Yates county, pursuant to
    5  their special duties serving as uniformed marine patrol officers,  COURT
    6  SECURITY  OFFICERS  OR  ANIMAL CONTROL OFFICERS; provided, however, that
    7  nothing in this subdivision shall be deemed to authorize such officer to
    8  carry, possess, repair or dispose of a firearm  unless  the  appropriate
    9  license  has  been issued pursuant to section 400.00 of the penal law or
   10  to authorize such officer to carry or possess a firearm except while  on
   11  duty.
   12    S 2. This act shall take effect immediately.
