AN ACT to amend the education law, in relation to admission to a special
high school in the city school district in a city having a population
of one million or more
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subdivision 4 of section 2590-g of the education law, as
2 amended by chapter 345 of the laws of 2009, is amended to read as
3 follows:
4 4. subject to the provisions of section twenty-five hundred ninety-i
5 of this article, maintain such jurisdiction over city-wide educational
6 policies governing the special, academic, vocational, and other high
7 schools authorized by this article [before the effective date of this
8 section] as the respective community district education councils main-
9 tain over the schools within their jurisdiction, which shall not be
10 construed to require or authorize the day-to-day supervision or the
11 administration of the operations of such schools. Provided, further,
12 the city board shall establish procedures and standards for admission to
13 the special high schools of the city district, which shall consist of
14 multiple measures of student merit including the grade point averages of
15 applicants, culminated student portfolio, teacher recommendations and
16 such other factors as the city board shall determine to be necessary.
17 § 2. Subdivision 4 of section 2590-g of the education law, as added by
18 chapter 720 of the laws of 1996, is amended to read as follows:
19 4. subject to the provisions of section twenty-five hundred ninety-i
20 of this article, maintain such jurisdiction over policies governing the
21 special, academic, vocational and other high schools authorized by this
22 article [before the effective date of this section] as the respective
23 community boards maintain over the schools within their jurisdiction,
24 which shall not be construed to require or authorize the day-to-day
25 supervision or the administration of the operations of such schools.

1 Provided, further, the city board shall establish procedures and stand-

3 which shall consist of multiple measures of student merit including the
4 grade point averages of applicants, culminated student portfolio, teach-
5 er recommendations and such other factors as the city board shall deter-
6 mine to be necessary.
7 § 3. Paragraph (b) of subdivision 1 of section 2590-h of the education
8 law, as amended by chapter 345 of the laws of 2009, is amended to read
9 as follows:
10 (b) all specialized [senior] high schools. The special high schools
11 shall include the present schools known as:
12 The Bronx High School of Science, Stuyvesant High School, Brooklyn
13 Technical High School, Fiorello H. LaGuardia High School of Music and
14 the Arts in the borough of Manhattan, and such [further] additional
15 schools which the city board may designate from time to time. The
16 special schools shall be permitted to maintain a discovery program in
17 accordance with the law in effect on the date preceding the effective
18 date of this section[; admissions to the special schools shall be
19 conducted in accordance with the law in effect on the date preceding the
20 effective date of this section];
21 § 4. Paragraph (b) of subdivision 1 of section 2590-h of the education
22 law, as amended by chapter 720 of the laws of 1996, is amended to read
23 as follows:
24 (b) all specialized [senior] high schools. The special high schools

35 § 5. This act shall take effect on the first of April next succeeding
36 the date on which it shall have become a law; provided that the amend-
37 ments to subdivision 4 of section 2590-g of the education law, made by
38 sections one and two of this act, shall apply to the Stuyvesant high
39 school, the Bronx high school of science, the Brooklyn technical high
40 school, the Staten Island technical high school, the Queens high school
41 for the sciences at York college, the high school for mathematics,
42 science and engineering at City college, the high school for American
43 studies at Lehman college, the Brooklyn Latin school, and all additional
44 schools that the board of education of the city school district of the
45 city of New York designates as special high schools, not including the
46 Fiorello H. LaGuardia high school of music and the arts; provided,
47 further, that the amendments to subdivision 4 of section 2590-g and
48 paragraph (b) of subdivision 1 of section 2590-h of the education law
49 made by sections one and three of this act shall be subject to the expi-
50 ration and reversion of such sections pursuant to section 34 of chapter
51 91 of the laws of 2002, as amended and subdivision 12 of section 17 of
52 chapter 345 of the laws of 2009, as amended respectively when upon such
53 date the provisions of sections two and four of this act shall take
54 effect.
