AN ACT to amend the public health law, in relation to the statewide
fibroid study program; and to amend the state finance law, in relation
to establishing the statewide fibroid study program fund
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The public health law is amended by adding a new section
2 267-b to read as follows:
3 § 267-b. Statewide fibroid study program. 1. The commissioner shall
4 establish within the department a statewide fibroid study program
5 through which the department will study and evaluate the occurrence of
6 fibroids and the alleviation of pain caused by these tumors. This
7 program shall:
8 (a) examine and evaluate current research and progress in the study of
9 fibroids;
10 (b) examine and evaluate current treatment methods for fibroids;
11 (c) identify potential barriers to access to treatment for fibroids;
12 (d) examine the symptoms and effects of fibroids on women of color;
13 (e) identify any potential barriers to access to treatment for
14 fibroids, in addition to barriers identified pursuant to paragraph (h)
15 of this subdivision, for women of color;
16 (f) make recommendations as the development of treatment methods for
17 fibroids;
18 (g) make recommendations to remove any potential barriers to access to
19 treatment of fibroids; and

1 (h) make recommendations to remove any potential barriers to access to
2 treatment of fibroids specific to potential barriers to access to treat-
3 ment faced by women of color.
4 2. Any entity dedicated to the advancement of reproductive health
5 shall be eligible to submit applications to receive funds from the
6 department for the purpose of advancing the study of fibroids. A grant
7 may be awarded upon submission of an application to the department.
8 3. On or before the first day of February each year, the commissioner
9 shall provide a written report to the temporary president of the senate,
10 speaker of the assembly, chair of the senate finance committee, chair of
11 the assembly ways and means committee, chair of the senate committee on
12 health, chair of the assembly health committee, the state comptroller
13 and the public. Such report shall include how the monies of the fund
14 were utilized during the preceding calendar year, and shall include:
15 (a) the amount of money disbursed from the fund and the process used
16 for such disbursements;
17 (b) recipients of awards from the fund;
18 (c) the amount awarded to each;
19 (d) the purposes for which such awards were granted; and
20 (e) a summary financial plan for such monies which shall include esti-
21 mates of all receipts and all disbursements for the current and succeed-
22 ing fiscal years, along with the actual results from the prior fiscal
23 year.
24 § 2. The state finance law is amended by adding a new section 87 to
25 read as follows:
26 § 87. Statewide fibroid study program fund. 1. There is hereby estab-
27 lished in the custody of the state comptroller a special fund to be
28 known as the "statewide fibroid study program fund".
29 2. The sources of funds shall consist of all moneys collected there-
30 for, or moneys credited or transferred thereto from any other fund or
31 source pursuant to law, or any other moneys made available for the
32 purposes of such fund.
33 3. (a) Moneys of such fund shall be expended to the department of
34 health to study fibroids and the alleviation of pain caused by fibroids.
35 (b) The department of health may also provide grants for the purpose
36 of advancing the study of fibroids.
37 4. Monies shall be payable from the fund on the audit and warrant of
38 the comptroller on vouchers approved and certified by the commissioner
39 of health.
40 § 3. This act shall take effect immediately.
