          printed to be committed to the Committee on Local Government
 
        AN ACT to amend chapter 158 of the laws of 1988 relating  to  establish-
          ment  of  a  library district in the town of Hurley, Ulster county, in
          relation to changing the hours of the library's  annual  election  and

          the organization of the board of trustees
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Paragraph (c) of subdivision 1 of section 2 of chapter  158
     2  of  the laws of 1988, relating to establishment of a library district in
     3  the town of Hurley, Ulster county, is amended to read as follows:
     4    (c) the election of [three]  trustees  as  hereinafter  provided.  The
     5  trustees  of  the West Hurley library shall give notice of said election
     6  by the publication of a notice in one or more newspapers having a gener-
     7  al circulation in the district to be served. The  first  publication  of
     8  such notice shall be not less than thirteen days and not more than twen-
     9  ty  days  prior  to the date of such election. In addition, the board of

    10  trustees of the West Hurley library shall cause copies of such notice to
    11  be posted conspicuously in five public places in the district  at  least
    12  thirteen  days  prior  to  the  date of such election. Such notice shall
    13  specify the time when and the place where such election  will  be  held,
    14  the issues to be decided at said election and the hours during which the
    15  polls  will be open for receipt of ballots. The board of trustees of the
    16  West Hurley library shall prepare the ballots for such elections and the
    17  polls shall remain open for the receipt thereof at  all  elections  from
    18  [seven] four o'clock p.m. until [ten] eight o'clock p.m., and such addi-
    19  tional  consecutive  hours prior thereto as the board of trustees of the
    20  West Hurley library may have determined  and  specified  in  the  notice

    21  thereof.  The  board  of trustees shall designate a resident taxpayer of
    22  such district to act as chairman of any election of  such  district  and
    23  shall  designate not less than two nor more than four resident taxpayers

     1  to act as election inspectors and ballot clerks at  such  elections.  No
     2  trustees  shall  serve  as  such chairman or as an election inspector or
     3  ballot clerk. The board of trustees may  adopt  a  resolution  providing
     4  that  such chairman, election inspectors and ballot clerks shall be paid
     5  for their respective services at the initial election or at  any  annual

     6  election  or  at  any  subsequent  special election. Such resolution, if
     7  adopted, may fix reasonable compensation for the services of  each  such
     8  official.  Every  voter  of the first, third, fifth and seventh election
     9  district of the town of Hurley otherwise qualified to vote at a  general
    10  town  election  shall  be  qualified to vote at said election. After the
    11  polls have been closed at said election,  the  election  inspectors  and
    12  ballot  clerks  shall  immediately canvass publicly the ballots cast and
    13  the chairman of the election shall publicly announce the result.  Within
    14  seventy-two  hours  thereafter,  the  chairman,  election inspectors and
    15  ballot clerks shall execute and file a certificate of the result of  the
    16  canvass  with  the board of trustees and with the town clerk of the town
    17  of Hurley.
    18    § 2. Section 3 of chapter 158 of the laws of 1988, relating to  estab-

    19  lishment  of a library district in the town of Hurley, Ulster county, is
    20  amended to read as follows:
    21    § 3. Organization  and  structure.  The  West  Hurley  public  library
    22  district  shall  be managed, operated and controlled by a board of trus-
    23  tees consisting of [nine] seven to eleven members. These trustees  shall
    24  at  the  first regular meeting of the board determine by lot the year in
    25  which each of their terms of office expire, [and the terms shall  expire
    26  as  follows:  After  one  year - three trustees; after two years - three
    27  trustees; after three years - three  trustees]  with  one-third  of  the
    28  board  expiring  each year. As vacancies occur trustees shall be elected
    29  at the annual election herein provided for to serve for three year terms

    30  by the voters of the library district  hereby  created,  said  terms  to
    31  commence  on  the first day of October next following the election. Only
    32  qualified voters of the district shall be eligible for election  to  the
    33  board  of trustees. The board of trustees at its first meeting each year
    34  shall elect or appoint a  president  and  vice-president  who  shall  be
    35  members  of  the board and a clerk, treasurer and such other officers as
    36  they deem necessary. If the board so determines, the  offices  of  clerk
    37  and  treasurer  may  be  held  by individuals who are not members of the
    38  board of trustees, and in that event, these officers may, if  the  board
    39  so determines, receive compensation as fixed by resolution of the board.
    40    § 3. This act shall take effect immediately.
