AN ACT to amend the environmental conservation law, in relation to the
addition of certain lands in the Carmans River Watershed to the
Central Pine Barrens Area and the Core Preservation Area; to repeal
chapter 538 of the laws of 2011 amending the environmental conserva-
tion law relating to the addition of certain lands within the Carmans
River Watershed to the core preservation area of the Central Pine
Barrens, relating thereto; and to repeal certain provisions of the
environmental conservation law relating thereto
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Legislative findings. The legislature finds that expanding
2 the Central Pine Barrens Area and the core preservation area, as estab-
3 lished in chapter 286 of the laws of 1998 will increase protection for
4 the Carmans River and its watershed and is a vital goal that benefits
5 the environment and the economy of the state. The Carmans River is one
6 of only two found within the Central Pine Barrens. As such, the Carmans
7 River represents a significant and integral part of the Central Pine
8 Barrens ecosystem. Although various state and local measures have been
9 undertaken to protect the Carmans River over the last several decades,
10 recent scientific studies have indicated that existing measures are
11 insufficient to protect the Carmans River. Further, the Carmans River
12 is declining in both the quality of its surface water and its ecological
13 integrity. The entire watercourse of the Carmans River lies within the
14 Central Pine Barrens and much of its groundwater watershed also lies
15 within the Central Pine Barrens and entirely within the town of Brookha-
16 ven. Accordingly, the most effective means of achieving the objectives
17 of environmental preservation of the Carmans River watershed and econom-
18 ic growth on other areas of the town of Brookhaven would be to expand

1 the core preservation area of the Central Pine Barrens. This legislation
2 is intended to and conditioned on the purpose that it: (1) expand the
3 core preservation area boundary to encompass those areas most critical
4 to the Carmans River; (2) include public parklands and open space areas
5 which are near or currently adjacent to the core preservation area and
6 which should be integrated into the core preservation area; (3) expand
7 the existing Central Pine Barrens area boundary to incorporate the boun-
8 daries of the expanded core preservation area; and shall only remain in
9 effect as long as the description and boundaries of such areas as estab-
10 lished in 1998, and the protections afforded such areas by such act are
11 not diminished in any way. Such intended expansion of the core preserva-
12 tion area will provide significantly more protection to the Carmans
13 River than currently exists and will help to ensure that key ecological
14 values and habitats will be adequately protected, enhanced and main-
15 tained.
16 § 2. Subdivisions 10 and 11 of section 57-0107 of the environmental
17 conservation law are REPEALED, and two new subdivisions 10 and 11 are
18 added to read as follows:
19 10. "Central Pine Barrens area" shall mean the contiguous area as
20 described and bounded as follows:
21 Beginning at a point where the southerly side of Route 25A intersects
22 the easterly side of Miller Place Road; thence southward along the east-
23 erly boundary of Miller Place Road to Helme Avenue; thence southward
24 along the easterly boundary of Helme Avenue to Miller Place-Middle
25 Island Road; thence southward along the easterly boundary of Miller
26 Place-Middle Island Road to Whiskey Road; thence westward along the
27 southerly boundary of Whiskey Road to Mount Sinai-Coram Road; thence
28 southward along the easterly boundary of Mount Sinai-Coram Road to
29 Middle Country Road (Route 25); thence westward along the southerly

13 undeveloped pine barrens as described and bounded as follows:
14 Beginning at a point where the northwestern corner of the New York
15 State Rocky Point Natural Resource Management Area (the "NYS Rocky Point
16 Land") intersects the southerly side of NYS Route 25A; thence generally
17 southward and eastward along the generally westerly and southerly bound-
18 aries of the NYS Rocky Point Land (including the Currans Road Pond State
19 Wildlife Management Area, all adjacent or contiguous undeveloped Town of
20 Brookhaven parks, preserves, open space areas, or reserved areas, and
21 the crossings of the undeveloped Suffolk County property known as the
22 Port Jefferson - Westhampton road right of way, Whiskey Road, County
23 Route 21, and Currans Road), and including those properties identified
24 as District 200, Section 346, Block 1, Lots 3 and 4, to the point where
25 the NYS Rocky Point Land meets the northerly side of NYS Route 25
26 (Middle Country Road); thence eastward along the northerly boundary of
27 NYS Route 25 to the southeastern corner of that property west of Wood-
28 lots Road which is identified as District 200, Section 349, Block 2, Lot

5 § 3. Chapter 538 of the laws of 2011 amending the environmental
6 conservation law relating to the addition of certain lands within the
7 Carmans River Watershed to the core preservation area of the Central
8 Pine Barrens is REPEALED.
9 § 4. Severability. The provisions of this act shall be severable and
10 if any portion thereof or the applicability thereof to any person or
11 circumstances shall be held invalid, the remainder of this act and the
12 application thereof shall not be affected thereby.
13 § 5. This act shall take effect on the first of January next succeed-
14 ing the date on which it shall have become a law provided that if the
15 provisions of this act establishing a new description and boundaries of
16 the Central Pine Barrens Area or the core preservation area removes or
17 excludes any of the lands of the Central Pine Barrens Area or the core
18 preservation area as such lands are described and bounded in chapter 286
19 of the laws of 1998, and/or protections established and/or provided by
20 such act, this act shall be deemed repealed and of no force and effect
21 and chapter 286 of the laws of 1998 shall remain in full force and
22 effect. The state legislature shall notify the legislative bill drafting
23 commission of any such decrease and resulting repeal in order that the
24 commission may maintain an accurate and timely effective data base of
25 the official text of the laws of the state of New York in furtherance of
26 effectuating the provisions of section 44 of the legislative law and
27 section 70-b of the public officers law.
