        Introduced  by Sen. RIVERA -- (at request of the New York Power Authori-
          ty) -- read twice and ordered printed, and when printed to be  commit-
          ted to the Committee on Energy and Telecommunications
 
        AN ACT to amend the public authorities law, in relation to the eligibil-
          ity  of  hospitals  in  the state to receive assistance from the power
          authority of the state of New York
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Paragraph  (a)  of  subdivision 17 of section 1005 of the
     2  public authorities law, as amended by chapter 494 of the laws  of  2011,
     3  is amended to read as follows:
     4    (a)  As  deemed feasible and advisable by the trustees, to finance and
     5  design, develop, construct, implement, provide and administer energy-re-
     6  lated projects, programs and services for any public entity,  any  inde-
     7  pendent not-for-profit institution of higher education within the state,
     8  any  general  hospital  located  in  the state, and any recipient of the
     9  economic development power, expansion power, replacement power,  preser-
    10  vation  power,  high  load  factor  power, municipal distribution agency
    11  power, power for jobs, and recharge New York power programs administered
    12  by the authority. In establishing and  providing  high  performance  and
    13  sustainable  building  programs and services authorized by this subdivi-
    14  sion, the authority is  authorized  to  consult  standards,  guidelines,
    15  rating  systems,  and/or criteria established or adopted by other organ-
    16  izations, including but not limited to the United States green  building
    17  council  under  its leadership in energy and environmental design (LEED)
    18  programs, the green building initiative's green  globes  rating  system,
    19  and the American National Standards Institute. The source of any financ-
    20  ing  and/or  loans  provided  by  the authority for the purposes of this
    21  subdivision may be the proceeds of notes issued pursuant to section  one
    22  thousand  nine-a of this title, the proceeds of bonds issued pursuant to

     1  section one thousand ten of this title, or any other available authority
     2  funds.
     3    §  2.  Paragraph  (b)  of subdivision 17 of section 1005 of the public
     4  authorities law is amended by adding a new subparagraph 3-a to  read  as
     5  follows:
     6    (3-a) "General hospital" has the same meaning ascribed to such term in
     7  subdivision ten of section twenty-eight hundred one of the public health
     8  law.
     9    § 3. This act shall take effect immediately.
