        Introduced  by  Sen.  CLEARE -- read twice and ordered printed, and when
          printed to be committed to the Committee on Finance
 
        AN ACT in relation to directing the department of environmental  conser-
          vation  to  develop and implement a tree planting pilot program in the
          ten zip codes in the state with the highest incidence of  asthma;  and
          making an appropriation therefor

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Within amounts appropriated  therefor,  the  department  of
     2  environmental  conservation  shall develop and implement a tree planting
     3  pilot program in the state. The department of environmental conservation
     4  shall consult with the department of health to  determine  the  ten  zip
     5  codes  in the state with the highest incidence of asthma. The department
     6  of environmental conservation,  in  consultation  with  local  agencies,
     7  shall  plant  trees  in  such  zip codes to ameliorate the environmental
     8  conditions in those areas. Such pilot program shall continue for a peri-
     9  od of five years after the effective date of this act.  At  the  end  of
    10  such  period, the department of environmental conservation, in consulta-
    11  tion with the department of health, shall report to  the  governor,  the
    12  temporary president of the senate and the speaker of the assembly on the
    13  results  of  such  pilot program and any recommendations for legislative
    14  action.
    15    § 2. The sum of ten million dollars ($10,000,000), or so much  thereof
    16  as  may  be necessary, is hereby appropriated to the department of envi-
    17  ronmental conservation from the general fund, for implementation of  the
    18  tree planting pilot program required by section one of this act.
    19    § 3. This act shall take effect April 1, 2024.
