        AN ACT to amend the executive law, in  relation  to  authorizing  public
          requests  for  information  from  any  county,  city, town, or village
          desiring to have any memorial located within their municipality listed
          within the veterans memorial registry; to amend the veterans' services
          law, in relation to directing the department of veterans' services  to
          establish a veterans memorial registry; and to repeal section 368-b of
          the executive law relating thereto
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Subdivisions 2 and 3 of section 368-b of the executive law,
     2  as added by a chapter of the laws of 2022, amending  the  executive  law
     3  relating  to  directing  the division of veterans' services to develop a
     4  veterans memorial registry, as proposed in legislative bills numbers  S.
     5  8729 and A. 9590, are amended to read as follows:
     6    2. The registry shall consist of a searchable database of those veter-
     7  ans memorials located within the state submitted pursuant to subdivision
     8  three  of  this  section. The registry shall include, but not be limited
     9  to, information regarding the location of a memorial  and  who  or  what
    10  veteran  or battle the memorial is honoring.  Additional information may
    11  include historical information such as who authorized  the  erection  of
    12  such  memorial  and  the year of the dedication.  Such registry shall be
    13  searchable by location, veteran or battle.
    14    3. [In developing such registry,] The state director shall  issue,  on
    15  behalf  of  the  division [may solicit information from local historians
    16  pursuant to section 57.09 of the  arts  and  cultural  affairs  law],  a
    17  public  request  for  information for any county, city, town, or village
    18  desiring to have any memorial located within their  municipality  listed
    19  within  the  registry.  Each  county,  city, town, or village may submit
    20  responses to the division's request for information at  any  time  after
    21  such  request for information has been issued. Individuals and organiza-
    22  tions, including but not limited to, local  veterans'  service  agencies
    23  staff, and members of congressionally chartered veterans' service organ-

     1  izations may [submit information for] provide recommendations to a muni-
     2  cipality  for  inclusion  in  the  registry[, on a form developed by the
     3  division]. In responding to the division's public request  for  informa-
     4  tion, a municipality shall identify the memorial or memorials it desires
     5  to  have  included  in  the registry and submit any information required
     6  pursuant to subdivision two of this section to the division.
     7    § 2. The veterans' services law is amended by  adding  a  new  section
     8  29-a to read as follows:
     9    §  29-a.  Veterans memorial registry. 1. The department is directed to
    10  develop a veterans memorial registry in consultation with  the  director
    11  of  the New York state military museum and veterans resource center, the
    12  commissioner of the office of parks, recreation and  historic  preserva-
    13  tion,  the  commissioner of the office of general services and the state
    14  historian. The registry shall be  made  available  on  the  department's
    15  website.
    16    2. The registry shall consist of a searchable database of those veter-
    17  ans memorials located within the state submitted pursuant to subdivision
    18  three  of  this  section. The registry shall include, but not be limited
    19  to, information regarding the location of a memorial  and  who  or  what
    20  veteran  or battle such memorial is honoring. Additional information may
    21  include historical information such as who authorized  the  erection  of
    22  such  memorial  and  the  year of the dedication. Such registry shall be
    23  searchable by location, veteran or battle.
    24    3. The state commissioner shall issue, on behalf of the department,  a
    25  public  request  for  information for any county, city, town, or village
    26  desiring to have any memorial located within their  municipality  listed
    27  within  the  registry.  Each  county,  city, town, or village may submit
    28  responses to the department's request for information at any time  after
    29  the  request  for information has been issued. Individuals and organiza-
    30  tions, including but not limited to, local  veterans'  service  agencies
    31  staff  and members of congressionally chartered veterans' service organ-
    32  izations may provide recommendations to a municipality for inclusion  in
    33  the  registry.  In  responding  to  the  department's public request for
    34  information, a municipality shall identify the memorial or memorials  it
    35  desires  to  have  included  in  the registry and submit any information
    36  required pursuant to subdivision two of this section to the department.
    37    § 3. Section 368-b of the executive law, as added by a chapter of  the
    38  laws of 2022, amending the executive law relating to directing the divi-
    39  sion  of  veterans' services to develop a veterans memorial registry, as
    40  proposed in legislative bills numbers S. 8729 and A. 9590, is REPEALED.
    41    § 4. This act shall take effect on the  same  date  and  in  the  same
    42  manner  as  a  chapter  of  the  laws of 2022 amending the executive law
    43  relating to directing the division of veterans' services  to  develop  a
    44  veterans  memorial registry, as proposed in legislative bills numbers S.
    45  8729 and A. 9590, takes effect; provided, however, that section three of
    46  this act shall take effect on the same date and in the  same  manner  as
    47  section  2  of  part PP of chapter 56 of the laws of 2022, takes effect.
    48  Provided, further:
    49    (a) that the amendments made to subdivisions 2 and 3 of section  368-b
    50  of  the  executive  law made by section one of this act shall not affect
    51  the repeal of such section and shall be deemed repealed therewith; and
    52    (b) that if section 2 of part PP of chapter 56 of  the  laws  of  2022
    53  shall  not  have taken effect on or before such date then section two of
    54  this act shall take effect on the same date and in the  same  manner  as
    55  section 2 of part PP of chapter 56 of the laws of 2022, takes effect.
