MEMORANDUM IN SUPPORT OF LEGISLATION

  TITLE OF BILL: An act to repeal section 1226 of the vehicle and traffic law relating to control of the steering mechanism   PURPOSE: This bill is designed to conform NY law to the law in the other forty- nine states and the European Community that is presently in the process of repealing a similar requirement.   SUMMARY OF PROVISIONS: The bill repeals section 1226 of the vehicle and traffic law.   JUSTIFICATION: This bill, if enacted, will conform the law in New York to the law in the other forty nine states and the anticipated standard in the European Community which is in the midst of repealing a similar requirement that a vehicle operator keep one hand on the steering mechanism at all times. This law which is difficult, if not impossible, to enforce in an even- handed manner is largely observed in the breach. With the present growth of autonomous technology that many will allow motor vehicles to safely more and more vehicle operations are becoming dependent on a vehicles computer system. One current example is the automatic parking option on many vehicles that parks the care safely without the assistance of the driver. Similar technologies and close to coming to the market that will take over other functions and there are companies that are working toward the development of a fully autonomous vehicle. Repeal of this mandate will put New York in line with this technology growth. It will help foster research and development on such technology in this state and allow the developers to undertake such important steps as introducing it at major events such as the NY International Auto Show and on the national news programs that originate in NY by allowing such innovative products to be legally demonstrated in the state.   LEGISLATIVE HISTORY: This is a new bill.   FISCAL IMPLICATIONS: To be determined   EFFECTIVE DATE:
